e. Case Development. When an employee claims to have been injured while performing<br />

representational functions, an inquiry should be made to the <strong>of</strong>ficial superior to determine whether<br />

the employee had been granted "<strong>of</strong>ficial time" or, in emergency cases, would have been granted<br />

<strong>of</strong>ficial time if there had been time to request it. If so, the claimant should be considered to have<br />

been in the performance <strong>of</strong> duty. This includes Postal Service employees who are "on the clock"<br />

while performing representational activities under the <strong>National</strong> Agreement.<br />

If the agency states that the employee was not performing an activity for which <strong>of</strong>ficial time is<br />

allowed, the Office should issue a letter warning the claimant that the case will be denied unless<br />

additional information is provided, and allowing thirty days for a response. If there is no timely<br />

response from the claimant, a formal decision should be issued on the ground that the claimant is<br />

not in the performance <strong>of</strong> duty.<br />

If the claimant provides evidence contradicting the agency's position, the <strong>of</strong>ficial superior should<br />

be asked to reply to this evidence, providing documentation in the form <strong>of</strong> appropriate<br />

regulations, executive order or union agreement covering the specific situation. The Office will<br />

accept the ruling <strong>of</strong> the agency as to whether a representative was entitled to <strong>of</strong>ficial time, unless<br />

this ruling is later overturned by a duly authorized appellate body.<br />
