2-1601 Exhibit 5: Request for Comment from Employing Agency<br />

REQUEST FOR COMMENT FROM EMPLOYING AGENCY<br />

Enclosed is a copy <strong>of</strong> the transcript <strong>of</strong> the hearing which was held in connection with the<br />

employee's Federal Employees' Compensation Claim. The employee's name, address, and<br />

case file number are contained in the transcript as well as the name and address <strong>of</strong> the<br />

designated representative, if any.<br />

While the employing agency is not a party to this hearing, it has an interest in the outcome<br />

and frequently possesses information pertinent to the issues addressed. By copy <strong>of</strong> this<br />

letter, therefore, a copy <strong>of</strong> the transcript has been provided to the employing agency in<br />

accordance with the appurtenant regulation (20 CFR 10.617). The employer is reminded<br />

that the contents <strong>of</strong> this document are Confidential in nature and should be handled<br />

accordingly.<br />

The employing agency will be allowed 20 calendar days (20 CFR 10.617(e)) from the date<br />

<strong>of</strong> this letter to submit comments or additional material for inclusion in the record and study<br />

by the Hearing Representative. Any comments or additional material the agency chooses to<br />

submit for consideration should be forwarded to the Hearing Representative at the address<br />

found at the top <strong>of</strong> this letter.<br />

Any such submission to the Hearing Representative should concurrently be forwarded to the<br />

designated representative or, in the absence <strong>of</strong> a representative, to the claimant, and the<br />

agency correspondence to the Hearing Representative should indicate that it has complied<br />

with this requirement. Comments and/or evidence must be received within the 20 day<br />

regulatory limitation.<br />

Participants at the hearing should carefully read the transcript. Any significant transcription<br />

errors (such as omissions, misattribution or missing portions) should be noted and<br />

corrections referencing page and line number should be returned to this <strong>of</strong>fice within 20<br />

days <strong>of</strong> the date <strong>of</strong> this correspondence. It is not necessary to return the entire transcript.<br />

If no significant errors are found, no further action is necessary.<br />
