2-0802-18 Cadets at State Maritime Academies<br />

18. Cadets at State Maritime Academies. OWCP has determined that cadets at state maritime<br />

academies in Maine, Massachusetts, New York, Texas and California are eligible to receive the benefits <strong>of</strong><br />

the <strong>FECA</strong> by reason <strong>of</strong> their status as enrolled members <strong>of</strong> the United States Maritime Service. The<br />

reports and certificates which OWCP requires <strong>of</strong> an <strong>of</strong>ficial superior may be completed by an appropriate<br />

<strong>of</strong>ficial <strong>of</strong> the state academy, who will in turn forward them to the Director, Office <strong>of</strong> Maritime Labor and<br />

Training, U.S. Department <strong>of</strong> Transportation, Maritime Administration, 400 Seventh Street, S.W.,<br />

Washington, D.C. 20590.<br />

The Washington <strong>of</strong>fice <strong>of</strong> the Maritime Administration will make the necessary inquiries and otherwise<br />

determine the accuracy <strong>of</strong> the reports and then forward them to the proper OWCP district <strong>of</strong>fice. The<br />

original submission <strong>of</strong> the basic compensation reports must include a certification from the Supervisor for<br />

State Maritime Academies showing whether at the time <strong>of</strong> the injury the individual was enrolled as a cadet<br />

in the U.S. Maritime Service.<br />

2-0802-19 PHS Employees Detailed to a State or Local Agency<br />

19. PHS Employees Detailed to a State or Local Agency. U.S. Public Health Service employees who are<br />

assigned to state or local agencies either maintain their Federal status in all respects, including<br />

entitlement to compensation, or are carried by PHS on leave without pay status and are paid by the state.<br />

In either case, they are entitled by law to benefits <strong>of</strong> the <strong>FECA</strong>.<br />

In all cases <strong>of</strong> PHS employees injured while assigned to state or local agencies, inquiries should be made<br />

to determine if they are receiving or have received benefits under a state compensation law. If so, the<br />

Public Health Service Act <strong>of</strong> 1943 requires that an election should be requested and must be made within<br />

one year. If the claimant elects <strong>FECA</strong> coverage, the state should be reimbursed from any compensation<br />

due, and the balance should be paid to the claimant.<br />

2-0802-20 Grand and Petit Jurors<br />

20. Grand and Petit Jurors. Pub. Law 97-463, effective January 12, 1983, provides that persons<br />

serving as grand or petit Federal jurors are entitled to benefits under the Act, for injuries occurring on or<br />

after that date.<br />

a. Coverage <strong>of</strong> jurors is limited to injury in, or arising from, situations where the juror is:<br />

(1) In attendance at court pursuant to a summons.<br />

(2) In deliberation.<br />

(3) At a location, such as the scene <strong>of</strong> a crime, for the purpose <strong>of</strong> taking a view.<br />

(4) Sequestered by order <strong>of</strong> a judge.<br />

A juror is not covered while traveling to and from home.<br />
