A lady named Sonali Dutta died in an unnatural way, so her brother lodged a complaint against<br />

Rajith Dutta, the victim Ashoke Ghosh, and another lady. The three were produced before the<br />

CJM and the victim was sent to Alipur Correctional Home as an under-trial prisoner.<br />

Ashoke Ghosh had high blood pressure, and was admitted to the hospital on 10 th December<br />

2007. His condition deteriorated, and on12th December 2007 Ashoke Ghosh died.<br />

An enquiry was conducted by Executive Magistrate Arabindo Mukhopadhay (not by a Judicial<br />

Magistrate, as per the amended s. 176(1A) Cr. P. C.), posted as Additional Land Acquisition<br />

Officer, South 24 Parganas.<br />

The next day, Ashoke Ghosh’s father’s name was written mistakenly on the Death Certificate.<br />

The inquest report showed marks on Ashoke Ghosh’s body, including a vertical black mark<br />

along his spinal cord, and two sore-like spots on his back. His nails were blackish, and a red<br />

liquid was found outside his nose.<br />

The post-mortem report was not signed by the autopsy surgeon.<br />
