On 13 June 2007, Laxmikanta Mondal filed a complaint u/s 365/366A/376 IPC (rape and kidnapping) in the court of the Chief Judicial Magistrate, Baharampur. On 15 Jun 2007 at 3.00am, Archana Mondal’s mother realised that her daughter had been kidnapped again. West Bengal 170 Later that morning, Sajera Bibi informed Laxmikanta Mondal that on 14 June 2007, seven or eight persons went to Rafikul Seikh’s house, and that she suspected this group of kidnapping Archana Mondal. Sajera Bibi also told Laxmikanta Mondal that after the kidnapping Rafikul Seikh put Archana Mondal in the residence of his brother-in-law Kamu Seikh in Sagarpara village, Jalangi PS. At 8.00am, Laxmikanta Mondal went to Jalangi PS to lodge a complaint, but ASI Swapan Saha refused to record the complaint. Archana Mondal is still missing. Other neighbours arrived, threw stones, and physically assaulted Archana and Mou Saha. Archana Saha and her family went to Baranagar PS to lodge a complaint, but the police did not record any General Diary, advising them to negotiate with their neighbours instead.
Later, ASI R.N. Pan came to Archana Saha’s house and demanded Rs. 300 for Sandhya Halder’s treatment. Archana Saha tried to tell the ASI what had actually happened, but he would not listen. Archana Saha went to North Suburban Hospital, where Dr. Manabendra Roy x-rayed her left hand. Archana Saha took the medical report to the police station. All tenants used to pay rent every month to Dilip Ghosh. Dilip Ghosh promised to transfer the lease to the tenants’ name, but died without having done so. After the death of Dilip Ghosh, his family and the tenants argued over the lease. The tenants filed a case in the Court of Learned Executive Magistrate against the family members u/s 144(2) Cr. P. C. On 22 July 2007 at around 11.00pm, Dilip Ghosh’s son Jayanta Ghosh came with three to four hundred local people to the property, intending to demolish the building with the ostensible motive of clearing garbage.
