The matter was reported to the Chief Judicial Magistrate of Alipore Court who ordered the DC<br />

and the OC of Alipore PS to produce Shiu Kumar Rajak.<br />

On 18 July 2007, the police produced Shiu Kumar Rajak u/s 380 of IPC (theft from dwelling) in<br />

the Criminal Court, Sealdah. The Court ordered Shiu Kumar Rajak into police custody until 21<br />

July 2007.<br />

On the same day, the police also filed a case u/s 353/307 IPC (attempted murder) and 25/27<br />

Arms Act and produced Shiu Kumar Rajak at the Alipore Court. The Chief Judicial Magistrate<br />

of Alipore Court granted Shiu Kumar Rajak’s bail petition and set bail at Rs. 500. The Court also<br />

directed the police to produce the Medical <strong>Report</strong> for Shiu Kumar Rajak’s injury on 21 July<br />

2007.<br />

As per a police request, the Additional Chief Judicial Magistrate of Sealdah Court ordered Shiu<br />

Kumar Rajak into police custody until 27 July 2007.<br />

On 23 July 2007, the police of Kalighat PS submitted a report showing no injury, as Shiu Kumar<br />

Rajak was checked at the outdoor department of the Seth Sukhlal Karnani Memorial Hospital.<br />

Case Details:<br />

Victim Sweety Shaw, age 20, married Rakesh Shaw in April 2007. Her father Hanumanmal<br />

Tatar did not approve of the wedding and forcibly took Sweety Shaw away to Mumbai.<br />

In August 2007, Rakesh Shaw went to meet his wife, but Hanumanmal Tatar learned of his<br />

arrival and took both of them to the police station. With the support of the police, Hanumanmal<br />

Tatar threatened Sweety and Rakesh Shaw.<br />

The police detained Rakesh Shaw so that he could not meet Sweety Shaw, despite the fact that<br />

they both were adults and their marriage was legally valid.<br />

A few days after being released from police custody, Rakesh Shaw had to return to Kolkata.<br />

Sweety Shaw had to stay in Mumbai.<br />
