On 21 January 2005 Rekha and her nephew lodged a complaint at Behala PS. Thereafter, she<br />

visited the PI several times to request that the PI investigate the matter and to inform him that<br />

Prabir Mitra and others regularly threatened her to withdraw the complaint.<br />

On 24 February 2005 Rekha filed a complaint to the SP of South 24 Parganas. Then, having no<br />

alternative, Rekha put the matter before the Hon’ble High Court and registered dated under<br />

section 304/34 of IPC against Prabir Mitra and others, on 24 September 2005. The POs<br />

arrested Shubhas and Apai. But after 15 days, they were released on bail.<br />

On 28 October 2005 investigating officer Uttam Banerjee and Behala SI locked victims in a cell<br />

and forced them to provide signatures for two letters, which were written by the police.<br />

On 7 July 2006 Rekha lodge a written complaint at Behala PS. Investigating officer Uttam<br />

Banerjee and Behala SI told Rekha not to bring the matter to media or press and suggested she<br />

close the matter.<br />

Case Details:<br />

Victims Montaj Ali, age 43, Amjad Ali, age 40, and Siyaj Ali, age 25, are brothers all live in Akuli<br />

village.<br />

On 27 August 2007, at around 12:00pm, Amjad and Siyaj were working in their farm lands<br />

when they witnessed some men (hereinafter, “the attackers”) destroying their paddy plants.<br />

When Amjad and Siyaj protested, the attackers beat them with sticks all over their bodies.<br />

Amjad and Siyaj sustained fractures all over their faces and bodies. Montaj arrived on the<br />

scene to help his brothers, but the attackers also beat him.<br />

Chanditala PS police officers arrived on the scene and took the brothers to the police station for<br />

medical treatment.<br />

The police officers also registered a case against the attackers. However, the Chanditala PS<br />

police officers only arrested those attackers who surrendered themselves to the police. The<br />

Chanditala PS police officers did not take any actions to independently pursue the other attackers.<br />
