When other shop owners asked the police officers what they were doing, the police responded that they were taking Bonick to Gaighata PS as part of an investigation. The officers said that they would return Bonick later that day. They left with Bonick in a white car. Around 10.00pm, Bonick’s mother went with two others to Gaighata PS. The officers there claimed to know nothing about the arrest. On 26 October 2006, an officer from Gaighata PS informed Bonick’s family that the police would produce Bonick before the Court of the Special Judge, Barasat, North 24 Parganas, on the following day.
On 27 October 2006, Bonick’s famly went to the court and learned that the police had charged Bonick with selling cannabis near the No. 9 Tank on 25 October 2007, contrary to s. 20(b) of the Narcotic Drugs and Psychotropic Substance Act 1987,. The judge remanded Bonick to jail. Bonick’s family is unclear how Bonick could have been selling cannabis on 25 October 2007 when he was taken into police custody on 22 October 2007. Inspector-In-Charge Sudip Roy became angry at the presence of a MASUM fact-finder in the PS and consequently threatened to implicate Bairagi in a serious case so that he would be unable to post bail.
