On 16 August 2003, when Dhiraj Bhattacharya was returning from a blood donation camp, Samar Basu’s wife and two sons beat him up. Dhiraj Bhattacharya went for treatment to the Serampore Hospital and lodged a Diary at Serampore PS (General Diary No. 990). No action was taken. Samar Basu was involved in several such cases in that area, so on 25 July 2005 the local people submitted a mass petition against him to the Inspector in Charge of Serampore PS, also sending copies to the SDO and the SDPO (Serampore). At that time, a case of hooliganism was also pending against Samar Basu in the Aerampore ACJM Court (No. C.R.241/05), in which Dhiraj Bhattacharya’s father Dwijendra Nath Bhattacharya was an eyewitness. When Samar Basu insulted and threatened Dwijendra Nath Bhattacharya, the latter lodged a General Diary at the Serampore PS (No. 433, dated 07.08.05), also sending written complaints to the SDPO (Serampore) and the Inspector in Charge of Serampore PS. No action was taken. On 9 August 2005, SI Rajib Bhattacharya of Serampore PS threatened Dwijendra Nath Bhattacharya on Samar Basu’s behalf. Samar Basu was a tenant at Atul Chandra Ghatak’s house; the two were parties to a longstanding civil case. Dhiraj Bhattacharya helped Atul Chandra Ghatak to evict Samar Basu pursuant to a High Court order of 15 May 2007. Subsequently, Samar Basu threatened the lives of both Dhiraj Bhattacharya and Atul Chandra Ghatak. On 22 May 2007, when Dhiraj Bhattacharya and Dwijendra Nath Bhattacharya were going to the dentist, Samar Basu’s wife and son insulted them. Samar Basu then attacked them with a knife; Dhiraj Bhattacharya’s face was severely injured.

One of his sons, victim Dhiraj Biswas, was a BSNL Officer and a Leucoderma patient, and was married to Radha Biswas. After Dhiraj and Radha Biswas’s marriage, there were petty quarrels between the two. Radha Biswas did not desire to live with her in-laws; one day, when Dhiraj Biswas was gone for some training, she took their daughter and went to her parents’ house. Afterwards, Dhiraj Biswas used to send money for Radha Biswas’s expenses and for their daughter’s education. However, Radha Biswas refused to return and to live with his family. When Dhiraj Biswas went to his in-laws’ house, he was beaten. Eventually, members of both families agreed to negotiate. They decided that, firstly, Dhiraj Biswas and Radha Biswas would stay with their own parents. Secondly, their daughter would stay with her mother, and Dhiraj Biswas would take her from her school every Friday and leave her at school on Monday. However, Dhiraj Biswas’s in-laws soon began trying to compel him to bring his daughter back to them. Radha Biswas’s family tried to influence Dhiraj Biswas through a local MLA, Chandana Ghosh Dostidar, but they did not succeed. Manik Kar, a local member of the CPI(M), also beat Dhiraj Biswas and made the same demand. On 13 August 2006, Dhiraj Biswas lodged a complaint at the Baisnabghata Investigating Centre. At 4.30pm, Radha Biswas and her family, along with many others, raided Dhiraj Biswas’s house and demanded the return of Dhiraj Biswas’s daughter. They demanded to know Dhiraj Biswas’s whereabouts, but his parents said that they did not know.
