was in police custody; the new statement described Khusi Bibi as a witness to Bajlur Rahman’s<br />
arrest memo – which they also falsely prepared.<br />
The Court of the CJM remanded Bajlur Rahman to judicial custody until 14 September 2006.<br />
Bajlur Rahman had filed a written complaint regarding the manner in which he was arrested and<br />
beaten in custody, and in which he was not produced before a court within twenty-four hours of<br />
his arrest – but the Magistrate did not care.<br />

MASUM has noted that, under the rules framed by the Supreme Court, the witness to an arrest<br />
memo must be either a family member of the arrested person or a respectable person in the<br />

Victim Abdul Kader worked as a middleman of the truck terminal in Sheikhpara market area.<br />
His family falls under the BPL list.<br />
On 12 th July 2007, Abdul Kader’s son Mirkasim went to the Seikhpara Bazaar to repair his<br />
torch. There, Mirkasim gave his torch to one Afjal Seikh for repair.<br />
Later, Afjal Seikh tried to give Mirkasim an old torch instead of his own torch. A scuffle arose.<br />
Afjal Seikh started beating Mirkasim in front of his shop.<br />
Abdul Kader rushed to the Bazaar to rescue Mirkasim, but Afjal Seikh beat him as well. Then<br />
Afjal Seikh forcibly confined Abdul Kader in the shop. The incident was witnessed by the local<br />
people.<br />
OC Purnachandra Ghosh of Raninagar PS arrived and arrested Abdul Kader. The police<br />
implicated Abdul Kader in an old criminal case (Raninagar PS Case No. 94/2007, dated<br />
22.05.2007) u/s 147/148/149/186/353/307 IPC. This case was unrelated to the incident in the<br />
Bazaar.<br />
422 local people filed a mass petition complaining against the police of Raninagar PS for their<br />
implication of Abdul Kader in the false case.
