On 1 January 2006, at 8.00pm, B.S.F. officers apprehended Saifuddin as he was traveling to his farm land to work. The B.S.F. officers took Saifuddun to his land and beat him with their batons, causing injuries all over body. After killing Saifuddin, the B.S.F. officers went to the nearest B.S.F. camp and collected smuggled items which they had seized in another incident. The B.S.F. officers intended to falsely claim that those items had actually been seized from Saffuidin. The B.S.F. officers took Saffuidin’s body and the seized items to the Raninagar PS. The B.S.F. officers then lodged a false complaint against Saffuidin, and also started a case of unnatural death. On 3 June 2006, at 4:00pm, Saffuidin’s wife lodged a written complaint with the Raninagar PS. The Raninagar PS has taken no subsequent action. Santosh was not at his home when the attackers arrived. However, the attackers failed so they next pursued Santosh’s brother, Sunil Sardar, who they chased to the front of Samir Sardar’s house. The attackers entered Samir’s house, beat him, and shot and killed him with 35 rounds of bullets. The attackers also beat Samir’s blind father.
During the attack, Santosh had telephoned Canning PS Officer Ashok Roy and requested help. However, a Canning PS police officer who was near the attack did nothing. Additionally, after the attacks, Sunil, Santosh, and others lodged several separate complaints with the Officer-in- Charge of the Canning PS. However, the Canning PS took no subsequent action. Santosh also lodged a complaint with the Canning Town Circle Inspector but the inspector took no follow-up action. Again, on 18 February 2006, Sunil Sardar lodged a written complaint with the Canning PS (Canning P.S. Case No-43 (2) dated 18/02/06 u/s 147/148/149/324/302/307/326 IPC+25/ 27Arms Act), and Bifal Sardar lodged complaints with Canning PS on 26 May 2006, 31 July 2006 and 7 August 2006. The police took no action in response to any of these complaints. Finally, Sunil Sardar lodged a complaint with the Circle Inspector, Canning Circle, Canning Town, south 24 Parganas describing all the attack, the attacker’s continued threats, and the Canning PS inaction. On 8 May 2007, Seikh and a companion attempted a cattle smuggling operation. They had the consent of the local BSF personnel (because the head smugglers conspire with the BSF, local police, and influential local persons to allow poorer persons to deliver the cattle). However, some other smugglers did not have the BSF’s consent, which angered the BSF personnel. As a result, BSF personnel fired their guns, and Seikh sustained two injuries.
