Victims Niranjan Byapari, age 44, and his wife Kalpana Byapari sell fish and also own a retail<br />

shop in Rabindra Palli.<br />

On 25 November 2006, a Communist Party of India activist (hereinafter, “attacker”) and his<br />

companions attempted to kill Niranjan with a weapon. Niranjan was taken to the Ghutiari Sharif<br />

Outpost and a General Dairy was lodged. Niranjan also filed a FIR with the Canning PS for<br />

attempted murder. As a result, the attacker was arrested on 4 April 2007 but he posted bail one<br />

week later.<br />

After the attacker’s release, he began threatening Niranjan. Niranjan received reliable information<br />

that the attacker might attempt to ransack his house. Niranjan took this information to the Ghutiari<br />

Sharif Outpost and lodged a General Diary on 7 February 2007. He also appealed for police<br />

assistance but was refused.<br />

On 13 February 2007, Shyam attacked Niranjan and his shop and attempt to rape Kalpana.<br />

Niranjan subsequently filed a criminal case at the court of Chief Judicial Magistrate Alipore.<br />

Accordingly, under the order of the court, a police case was started on 24 February 2007 at the<br />

Canning PS. The Canning PS Officer-in-Charge instructed the Officer-in-Charge of the Ghutiari<br />

Sharif Outpost to investigate the matter. However, the attackers have a very good relationship<br />

with the police, and, thus, no arrests have occurred.<br />
