Case Details:
Victim Soma Giri lives in Palpara within the jurisdiction of Jagacha PS.
Giri was raped and consequently impregnated. She gave birth on 26 November
2006. The baby was kept at the hospital for two days because she was weak.
On the same day, Giri’s filed a complaint against the rapist with the Jagacha PS. On
28 November 2006, the case was registered under section 376 of Indian Penal
Code, and the rapist was arrested.
On 28 th November 2006, Jagacha POs brought Giri and her baby to the PS. The
police interrogated Giri about the rape. The police detained Giri and her newborn
baby overnight.
In the night, the baby began to cry from the cold. The police refused to provide the
infant with any blankets. The next morning, the infant was pronounced dead. .
The Jagacha POs maintain that detaining Giri and her daughter was necessary to
conduct a DNA test.
