West Bengal 58 Case Details: Ershad Seikh belongs to a religious minority group and a socially and economically marginalised section of society. He is a rickshaw puller in Sialmara village. On 19 April 2007 at around 11.30am, while Ershad Seikh was returning from work, some police officers from Baharampur PS suddenly arrived in civilian clothing. The officers accused Ershad Seikh of stealing some articles and then whisked him away to the station in their vehicle. In the vehicle, Ershad Seikh found one Rinku Seikh, also arrested on the same charges. In the police lock-up, SI Kartik Majhi and another officer beat Ershad Seikh and Rinku Seikh in order to obtain a confession. On 20 April 2007 at around 11.00am, the police released Ershad Seikh and Rinku Seikh without any case or record. The SI gave Ershad Seikh Rs. 100 for medical treatment and obtained his signature on a blank paper. On 9 February 2007, Deepa Roy went for tuition but did not return home that the normal hour. She was not found until 10.00pm. Deepa Roy was examined by a local doctor, who identified that she had been raped and referred her to the J.R. Dhal Hospital (Bongaon General Hospital). Gopal Roy informed Deepa Roy’s uncle Harekrishna Roy that Deepa Roy had met with a bicycle accident. Harekrishna Roy rushed with another of Deepa Roy’s uncles, Patirosh Haldar, to the hospital, where they found that Deepa Roy had serious injuries caused by rape. Gopal Roy was present at the time. At 11.30pm, police officers from Gaighata PS arrested Gopal Roy at the Hospital in front of his father. They did not produce any warrant. Harekrishna Roy and Patirosh Haldar had Deepa Roy rushed to Kolkata R.G. Kar Hospital for better treatment. There, the doctors demanded the case number and said that they could not proceed with the treatment without a complaint, as this was a rape case. Therefore, Harekrishna Roy lodged complaint at the Gaighata PS against Gopal Roy on 10 February 2007 u/s 376 IPC. ASI R. Biswas was appointed as the Investigating Officer. On 12 February 2007, Gopal Roy was produced before the court. OC Jogindranath Dutta of Gaighata PS had fabricated documents to show that Gopal Roy had been arrested at the Chandan Market on 11 February 2007. The police strongly opposed granting bail to Gopal Roy.
