On 27 February 2007 at 3.00pm, while they were away, Sukumar Chandra Das ransacked and<br />
damaged the part of the house where Champa Das and her daughter resided.<br />
Champa Das went to the New Barrackpur Police Out Post to lodge a complaint. Duty Officer<br />
Gain refused to receive her complaint, telling her instead to lodge her complaint in a court; he only<br />
agreed to lodge a General Diary Entry.<br />

Champa Das filed a case u/s 144(2) Cr.P.C., and submitted copies of the order to the Ghola PS<br />
and the New Barrackpur Police Out Post. Thereafter, officials of Barrackpur Police Out Post<br />
forced Champa and Deblina Das to stay in their house, which was not safe for them. Though the<br />
police took note of the damage to the house and the furniture, they refused to lodge an FIR.<br />
While Champa Das is at work, Deblina Das must stay at home alone. On these occasions,<br />
Sukumar Chandra Das threatens and frightens Deblina Das.<br />

Case Details:<br />
Victims Chhakat Ali Biswas, Ayijuddin Biswas and Rasida Bibi reside in Dayarampur village. On<br />
5 th July 2004, five individuals, including Mrinnal Biswas, Pintu Mondal, Akram Mondal and<br />
Negar Hossain Mondal, attacked Ayijuddin and his family. The perpetrators beat and injured<br />
Ayijuddin. Chhakat Ali Biswas’s wife lodged an FIR at Jalangi PS. Thereafter, the perpetrators<br />
threatened to kill the victims.<br />

2007<br />
On 6 th October 2007, the perpetrators attacked the victims at their house with a bomb and<br />
firearms. Ayijuddin and his family took shelter in the BSF Camp. On 7 th October 2007, Chhakat<br />
Ali went to the Jalangi PS to lodge a complaint against the perpetrators. SI Tuhin Biswas refused<br />
to file an FIR. He stated that the police would only take action when they received a dead body.<br />
In spite of the availability of witnesses, the police refused file an FIR.<br />
Chhakat Ali Biswas lodged a complaint to the SP of Berhampore, but no action has yet been<br />
taken.
