Yasmin Banoo’s sons Sarfaraz and Amir Ali asked the officers why their parents were being<br />

arrested. SI M.S. Das told them that the charge was u/s 325/114 IPC (voluntarily causing<br />

grievous hurt, being an abettor present when an offence is committed).<br />

At 9.00pm, Sarfaraz and Amir Ali went to the station with advocate Jamil Farukh. Jamil Farukh<br />

signed a bail bond for Yasmin Banoo and requested bail for the other two detainees. The SI said<br />

that he could not grant bail for the others because of pressure from higher authorities.<br />

At 1.00pm, Shaukat Ali and Manzar Hussein, with a rope tied around their waists, were brought<br />

to Chittaranjan Hospital for a medical check-up.<br />

At 1.45pm, Shaukat Ali and Manzar Hussein were brought to the Alipore Court.<br />

At 5.15pm, Shaukat Ali and Manzar Hussein were released from the court lock-up.<br />

Case Details:<br />

Victim Shib Prasad Kayal, age 32, was a drug addict. He suffered from HIV, tuberculosis, and<br />

necrotic ulcers of the maxillary sinus. He was a habitual offender: according to Second Officer<br />

M. Gargari of Behala PS, Kolkata, the police arrested him seven or eight times under allegations<br />

of theft.<br />

As Shib Prasad Kayal belonged to a very poor family, his mother Amiya Kayal sought help from<br />

the Behala PS for his treatment. The police of Behala PS agreed.<br />

On 2 February 2007, the police took Shib Prasad Kayal to the Behala PS.<br />

The next morning, Amia Kayal went to the Behala PS. There, Shib Prasad Kayal told her that<br />

the police had not admitted him to any hospital, but rather had kept him in the lock-up.<br />

On 4 February 2007, Amia Kayal returned to the Behala PS and learned that the police had filed<br />

a false dacoity case against Shib Prasad Kayal. He had been sent to Court and then to the<br />

Alipore Central Jail, Kolkata.<br />
