On 27 February 2007 at 3.00pm, while they were away, Sukumar Chandra Das ransacked and damaged the part of the house where Champa Das and her daughter resided. Champa Das went to the New Barrackpur Police Out Post to lodge a complaint. Duty Officer Gain refused to receive her complaint, telling her instead to lodge her complaint in a court; he only agreed to lodge a General Diary Entry. West Bengal 106 Champa Das filed a case u/s 144(2) Cr.P.C., and submitted copies of the order to the Ghola PS and the New Barrackpur Police Out Post. Thereafter, officials of Barrackpur Police Out Post forced Champa and Deblina Das to stay in their house, which was not safe for them. Though the police took note of the damage to the house and the furniture, they refused to lodge an FIR. While Champa Das is at work, Deblina Das must stay at home alone. On 5 th July 2004, five individuals, including Mrinnal Biswas, Pintu Mondal, Akram Mondal and Negar Hossain Mondal, attacked Ayijuddin and his family. The perpetrators beat and injured Ayijuddin. Chhakat Ali Biswas’s wife lodged an FIR at Jalangi PS. Thereafter, the perpetrators threatened to kill the victims. Annual Report on Torture 2007 On 6 th October 2007, the perpetrators attacked the victims at their house with a bomb and firearms. Ayijuddin and his family took shelter in the BSF Camp. On 7 th October 2007, Chhakat Ali went to the Jalangi PS to lodge a complaint against the perpetrators. SI Tuhin Biswas refused to file an FIR. He stated that the police would only take action when they received a dead body. In spite of the availability of witnesses, the police refused file an FIR. Chhakat Ali Biswas lodged a complaint to the SP of Berhampore, but no action has yet been taken.

They are members of the Scheduled Caste community. Debnarayan Haldar’s family had a conflict with their neighbour, Nityananda Mondal, regarding some land. On 20 August 2007 at 8.00am, Nityananda Mondal’s brother Pintu Mondal trespassed onto Debnarayan Haldar’s family’s agricultural land and beat Debnarayan Haldar’s father Krishnapada Haldar almost to death. Some nearby farmers notified Debnarayan Haldar, who came to rescue his father. When he arrived, Nitayanda Mondal hit him with a spade on his back and then bit his upper lip. Debnarayan Haldar went unconscious. When Debnarayan Haldar’s wife arrived to rescue him, Nityananda and Pintu Mondal molested her. Some neighbours took Debnarayan Haldar to Gosaba PS to lodge a complaint, but the officers there only filed a General Diary Entry. The neighbours had Debnarayan Haldar admitted to the Gosaba Hospital, where he underwent treatment for six days. On 27 August 2007, Debnarayan Haldar was transferred to Bangur State Hospital for better treatment. On 28 August 2007, Debnarayan Haldar lodged a written complaint by post with the Gosaba PS, but the police ignored his complaint. Debnarayan Haldar also lodged complaints with the Superintendent of Police (South 24 Parganas) and the SHRC. No action was taken. On 30 August 2007, Debnarayan Haldar filed a case against the perpetrators in the Court of Learned Additional Chief Judicial Magistrate, Alipore u/s 148/447/448/323/325/326/506(II)/34 IPC and 156(3) Cr.P.C. The officers of Gosaba PS did not take any legal action and took a stand strongly in favour of Nityananda and Pintu Mondal because the latter were influential.
