West Bengal 244 On 6 February 2007 at 5.00pm, Banashree Malik was playing on the roadside with her friends. At the same time, a band of armed police personnel was marching on the road and threatening the villagers. Banashree Malik, like others, tried to escape and to return home. One of the officers identified Banashree Malik as the daughter of Pasupati Malik. He hit her with a lathi on her waist. Banashree Malik cried in pain. Banashree Malik was admitted to the Singur Rural Hospital. On 7 February 2007, Banashree Malik was discharged from the Hospital, having been advised to have an x-ray of her pelvic region. Pasupati Malik and other members of Banashree Malik’s family were so scared that they did not dare to lodge a complaint against the officer. He had several copies of a certificate, for which he paid Rs. 8,000, permitting him to cultivate the land on a particular island in the Padma River. When BSF personnel enquired about Samsul Seikh’s cultivation, he handed them his certificate, which was registered as BSF Entry No. 431. On 25 May 2007, Assistant Commandant Nitish Pramanik noticed one record in which it was written that Samsul Seikh went to his land but did not return, and that Samsul Seikh had refused to pay Rs. 8,000 as per BSF records. The Assistant Commandant and four BSF offiers arrested Samsul Seikh, and beat him in detention after seizing the copies of his certificate and his original Voter Identity Card. Samsul Seikh complained to victim Belu Rani, the Prodhan [head of elected body] of Katlamari II Gram Panchayat. On 26 May 2007, Assistant Commandant Nitish Pramanik called Belu Rani to meet him. At 8.00am, Belu Rani went with two colleagues, victims Praneet Kumar Pramanik and Mohammad Molla to the Assistant Commandant’s office.
At his office, the Assistant Commandant insulted the three victims. He treated Belu Rani shabbily and turew her from the camp. Around 200 villagers witnessed his behaviour. Belu Rani lodged a complaint at Raninagar PS (General Diary Entry No. 1213). No action was taken. Belu Rani lodged complaints with the OC of Raninagar PS, the BDO, and the DM (Berhampore). Mazumdar, SI Location : Singur PS, Hooghly District, West Bengal Date of incident : 04/02/2007 West Bengal 245 Case Detail: On 4 th February 2007, nearly 150 villagers of Beraberi and adjoining villages under Singur PS assembled near the fences erected by the administration at the Tata Motors installation. At around 10.30am, the police arrived and beat the protesters with lathis. They pulled the women’s hair and insulted them. The police fired tear-gas shells at the village, causing one hutment to burn down. They beat Amithabha Bhattacharya, pinned him to the ground, and dragged him to their vehicle. All of this was recorded in audio and video media. The police arrested a number of protesters, including Anuradha Talwar of the Right to Food Network and some leaders of the peoples’ movement. They filed charges (Singur PS Case No. 25, dated 04.02.07), u/s 147/ 148/ 149/ 448/ 186/ 332/ 333/ 325/ 326/ 353/ 307 IPC, 9(B) of the IE Act, and 3 and 4 of the P.D.PP Act. The charge was registered at 4.35pm, despite that the arrests took place between 11.00am and 11.30am. Some arrestees were admitted to the Singur Block Hospital with injuries. Ganga Das, Kabita Bag, and Mamata Manna – all unconscious – were treated at the Singur Primary Health Centre. Some were referred to the District Hospital in Chuchura, and were later shifted to Calcutta Medical College Hospital. However, some of the grievously injured were denied medial treatment. The arrestees were produced before the ACJM Court, Chandannagar. Judge Apurba Singha Roy granted bail to all of them except Amitabha Bhattacharjee, Gopal Pal, and Becharam Manna.
