NEW AR A VENU FROM GROVE STREET TO JERSEY AVENU (Wim<br />

BAROWIERI STREETS INERSECTION KEPT OPEN) AN BAY STRET FROM<br />

ERI STRET TO NEWAR AVENUE BEGINING NOON AN ENDING 7:00 P.M.<br />

SATURAY, SEPTEMBER 17, AN SUNAY, SEPTEMBER 18, 2011 AT THE<br />

REQUEST OF TH mSTORIC DOWNTOWN SPECIA IMROVEMENT DISTRICT<br />

FOR THE PUROSE OF A STREET FAI<br />

WHREAS, the Division of Engineering, Traffic and Transporttion has received an appIlcation from<br />

The Historic Downtown Special Improvement Distrct to close both Newark Avenue from Grove Street to <strong>Jersey</strong><br />

Avenue (with BarowÆrie Streets intersection kept open) and Bay Street from Erie Street to Newark Avenue<br />

beginning Noon and ending 7:00 p.m., Saturdày; September 17, and Sunday, September 18, 2011, for the purpose ofa<br />

street fair; and<br />

WHREAS, in accordance with the provisions of Section 296-71 and 296-72, a street may be<br />

temporarily closed for a block par or any recreational event to be conducted within an area not exceeding one city<br />

block under certin conditions; and .<br />

WHEREAS, when one or more of the required conditions for a street closing are not met, in<br />

accordance with Sections 296-74 (B) the Traffc Engineer may recommend to the <strong>City</strong> Council that one or more of<br />

the requirements of Sections 296-71,296-72 (B)(2)(8) and 296-73(D) be waived; and<br />

WHEREAS, theiequest to close both Newark Avenue and Bay Street and does not meet one or more of<br />

the requirements set forth in Sections 296-71, 296-72(B)(2)(8) and 296-73(D) because the application for the street<br />

closure was submitted by an Organization, not a resident and the street closure exceeds one block; and<br />

WHEREAS, the closing of the aforementioned streets wil not affect public safety or convenience, and in<br />

accordance with the provision of Section 296-74 (8) and the applicant has made a request to the <strong>City</strong> Council that one<br />

or more of the requitementsset forth in Section 296-71, 296-72(B)(2)(8) and 296- 73(D) be waived.<br />

NOW THEREFORE BE IT RESOLVED, that the Municipal Council via adoption of this<br />

resolution authorizes the closing of Newark Avenue from Grove Street to <strong>Jersey</strong> Avenue (with BarowÆrie Streets<br />

intersection kept open) and ay et from Erie Street to NewarkAvenue beginning Noon and ending 7:00 p.m.<br />

Saturday, September 17, and. u y September i8, 2011.<br />
