Article 1
Purpose and Scope of Agreement
The purpose of this Agreement is for the School District to provide food services
at the City's pool located at 395 Johnston Avenue. The School District shall
provide food, other supplies, and employees necessary for operating the'
concession station located at the ,pool during hours when the pool is opÈm.
. School District employees may include. high'.school students from the School
District's culinary arts program. It is anticipated that the School District. shall
provide food services during the hours of approximçitely 10 a.m. tô6 p.m.
However; such hours may be adjusted by the School District depending on the
volume of business generated.
The City shall provide for mair:tenance of the concession station, including repair

of all equipment on site and regular maintenance of the site.. The. men u for the
concession station shall be determined by the School District and subject to
change by Schoöl District. The menu and corresponding prices to be charged by
the School District are setforth in "Addendum An attached to this agreement and
made a part hereof.
Article 2
Term of Agreement
· The term of this Agreement shall be June 25, 2011 through September 5, 2011.
Article 3
Compensation and Payment
No money shall be exchanged between the parties in exchange for this
agreement.
Article 4
Contractual Relàtionship
1. In performing the services under this Agreement, the School District shall
operate and have the status of an independent contractor and shall not act as an
agent or employee of the City,. As an independent contractor, the School District
shall be solely responsibie for determining the means and methods of performing
the services described in the Scope of Services.
2. The School District shall peifor~ .the services to be furnished under this
Agreement with the degree of skil and care that. is required by customarily
accepted competent practices to assure. that all services are adequate and
apprcipriate for the purposes intended.
