RESOLUTION AUTHORIZING THE AWAR OF CONTRAC<br />

ZOLAND CORPORATION FOR MANTENANCE AND REPAIR<br />

HEAVY DUTY VEHICLES, CLASS 5 OR HIGHER OVER 15,000 L<br />

GVW UNDER STATE CONTRACT FOR THE DIVISION OF<br />

AUTOMOTIVE SERVICES<br />

COUNCIL OFFERED AND MOVED<br />

ADOPTION OF THE FOLLOWING RESOLUTION:<br />

WHEREAS, maintenance and repair for heavy duty vehicles are needed to keep the <strong>City</strong><br />

of <strong>Jersey</strong> <strong>City</strong>'s (<strong>City</strong>) vehicle fleet operational; and<br />

WHREAS, N.J.S.A. 40A:11-l2 of the Local Public Contracts Law authorizes<br />

muncipalities to use a State contract without public bidding and NJ.A.C. 5:34-7.29(c) requires<br />

<strong>City</strong> Council authorization for contracts exceeding $36,000.00; and<br />

WHEREAS, Zoland Corporation, 1742 Kennedy Boulevard, <strong>Jersey</strong> <strong>City</strong>, New <strong>Jersey</strong><br />

07305, being in possession of State Contract A 73526 , submitted a proposal for maintenance<br />

and repair for heavy duty vehicles; and<br />

WHEREAS, the contract term is for six months (6) months effective as of July 1, 2011<br />

to December 31, 2011 and the total cost of the contract shall not exceed $50,000.00; and<br />

WHEREAS, fuds in the amount of $20,000.00 are available in Automotive Operating<br />

Account No. 11-01-201-26-315-310.<br />

NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the <strong>City</strong> of<br />

<strong>Jersey</strong> <strong>City</strong> that:<br />

1) A contract is awarded to Zoland Corporation for maintenance and repair for<br />

heavy duty vehicles;<br />

2) The contract term is for six (6) months effective as of July1, 2011, and the tota<br />

cost ofthe contract shall not exceed $50,000.00;<br />

3) This contract is awarded without public bidding pursuant to NJ.S.A. 40A:ll-<br />

12;<br />

4) Pursuat to N.J.A.C. 5:30-5.5(a), the continuation of the contract afer the<br />

expenditue of fuds encumbered in the 2011 calendar year temporary budget<br />

shall be subject to the availability and appropriation of suffcient fuds in the<br />

2011 calenda year permanent budget; .<br />

5) Upon certification by an offcial or employee<br />

of the <strong>City</strong> authorized to receive<br />

the material pursuat to the contract, that the same has been received and that<br />

the requirements of the contract met, then; payment to the contractor shall be<br />

made in accordance with the provisions of the Local Fiscal Affairs Law,<br />

N.J.S.A. 40A:5-1~gm; and<br />

6) Ths contract award shall be subject to the condition that the vendor provides<br />

g II satisfactory evidence of compliance with the Afrmative Action Amendments<br />
