3. LIMITATION OF LIABILITY

COMMRCIAL. DAMGES OR LOSSES, ARSING OUT OF OR RELATED TO
CUSTOMER'S USE OR INABILITY TO USE A TERMAL, COMPUTER, LAN
DEVICE, PRITER, A COMMCATIONS DEVICE DUE TO A FAILUR OF A .
TIDRD PARTY VENDOR OR DISABLED INTERNT CONNCTIyiTY, HOWEVER
CAUSED, REGARLESS OF TH THEORY OF LIABILITY (CONTRCT, TORT OR
OTHRWISE) AN EVEN IF GTBM HAS BEEN ADVISED OF TH POSSIBILITY OF
SUCH DAMGES.
4. TERMINATION
a) GTBM may terminate this Agreement if GTBM gives written notice to the Customer
specifying the Customer's failure to make payment when due and the Customer then fails
to make such payment within ten (10) days following receipt of such notice.
b) Either part may also terminate this Agreement by written notice to the other, effective
immediately upon receipt, if the other part shall file, å petition in banklliptcy, shall be
adjudicated to be bankpt, shall take advantage of the insolvency laws of any state,
territory or country, shall make an assignment for the benefit of creditors, shall be
voluntarily or involuntarily dissolved, shall admit in writing its inabilty to pay debts as
they come due, or shall have a receiver, trustee or other court officer appointed for its
propert.
c) Termination of this Agreement does not relieve either part of obligations to make any
payments or perform any services due prior to the date of termination.
