3. LIMITATION OF LIABILITY<br />

IN NO EVENT SHAL GTBM BE LIABLE FOR PERSONAL INJUY, OR AN<br />

INCIDENTAL, PUNTIVE, SPECIA, INIRECT OR CONSEQUENTIAL DAMGES<br />

WHTSOEVER, INCLUDING, WITIOUT LIMITATION, DAMGES FOR LOSS OF<br />

PROFITS, LOSS OF DATA, BUSINSS INERRUPTION OR AN OTHR<br />

COMMRCIAL. DAMGES OR LOSSES, ARSING OUT OF OR RELATED TO<br />

CUSTOMER'S USE OR INABILITY TO USE A TERMAL, COMPUTER, LAN<br />

DEVICE, PRITER, A COMMCATIONS DEVICE DUE TO A FAILUR OF A .<br />

TIDRD PARTY VENDOR OR DISABLED INTERNT CONNCTIyiTY, HOWEVER<br />

CAUSED, REGARLESS OF TH THEORY OF LIABILITY (CONTRCT, TORT OR<br />

OTHRWISE) AN EVEN IF GTBM HAS BEEN ADVISED OF TH POSSIBILITY OF<br />

SUCH DAMGES.<br />

4. TERMINATION<br />

a) GTBM may terminate this Agreement if GTBM gives written notice to the Customer<br />

specifying the Customer's failure to make payment when due and the Customer then fails<br />

to make such payment within ten (10) days following receipt of such notice.<br />

b) Either part may also terminate this Agreement by written notice to the other, effective<br />

immediately upon receipt, if the other part shall file, å petition in banklliptcy, shall be<br />

adjudicated to be bankpt, shall take advantage of the insolvency laws of any state,<br />

territory or country, shall make an assignment for the benefit of creditors, shall be<br />

voluntarily or involuntarily dissolved, shall admit in writing its inabilty to pay debts as<br />

they come due, or shall have a receiver, trustee or other court officer appointed for its<br />

propert.<br />

c) Termination of this Agreement does not relieve either part of obligations to make any<br />

payments or perform any services due prior to the date of termination.<br />
