Dear Mr. Weller,<br />

. We understand that the decision has been made to bid the West District Precinct building project for a third time. That<br />

decision, and its implications regarding modifcations to our documents, means that our agreement with the <strong>City</strong> needs to<br />

be modifed again. Under our Agreement, these circumstances wil necessitate Additional Services from us and from other<br />

members of our Design Team, for which weare entitled to additional compensation. (These are above and beyond the .<br />

variety of Additional Services previously requested of us and previously approved by the <strong>City</strong> CounciL.)<br />

As you requested during the most recent bidding (the second bidding), we assume. that your office wil perform several of<br />

the Bidding Phase Services we would customariiy perfonI, in order to help reduce our Additional Fee for this, the third<br />

bidding. Specifically, the following changes wil be made in the scope of our Bidding Phase Services:<br />

1. Do not èonduct a Pre-Bid Conference or conduct it without a representative of our office in attendance.<br />

2. Conduct the Bid Openig without a representative of our office in attendance.<br />

3. Use Division of Archtecture personnel to perform the due dilgence services associated with the low bidder, to<br />

prepare the due dilgence, and to issue a recommendation to the <strong>City</strong>for award of the Contract.<br />

4. Do not conduct a Pre-Award Conference or conduct it without a representative of our òffice in attendance.<br />

The revised Construction Schedule, in combination with various directions we received at that recent ineeting, :necessitate<br />

. additional modifications to our Agreement with the <strong>City</strong> for this project. The followihg paragraphs describe those.<br />

changes. The spreadsheet at the endo.f this. Proposal shows the fees associated with these chahges. As you can see, each of<br />

the individual items in the spreadsheet is quite modest. It is the wide range of services requested of us that results in the<br />

substantial total.<br />

DETAILS OF CHANGES:<br />

1. Lengthen the Constrction Period: At your request, and consistent with the recommendations of your<br />

Constrcton Manager and ths office, the Contractual Constrction Period wil be increased froni 12 to 14<br />

months. This wil necessitate 2 additional months of Constrction Admistration Phase Serviees. Our monthly<br />

rate for these additional months wil be the same as the monthy rate for each of the origial 12 months: $5,000.<br />

Therefore, the Additional Fee associated with ths 2-month tie extension shall be $10,000. Any Constrction<br />

Phase Services beyond that period shall constitute Additional Services.<br />

2. Rebid the Project: Certåin Professional Servces. are required of the Design Team during the rebidding. These<br />

include the Plang Meetig I attended at your office in April, plus fielding questions from bidders and issuing<br />

Addenda, as needed. Certai of our Coilultants have also allowed time for that latter service, based on the types<br />

of questions they have received in the prior bid dings and their experience on rebidding of other similar projects.<br />
