Article 1
Purpose and Scope of Agreement
The purpose of this Agreement is for the Jersey City Police Department to share
the.use of their License Plate Recognition Technology (LPR) with the Jersey City
Parking Authority through the inclusion in the data base of the LPR parking
scofflaws. The use and operation of the LPR shall be done in a manner
consistent with the Guideline on the use of LPR as. set out by the Attorney
General for the State of New Jersey. The Jersey City Parking Authority shall
regularly prepare an updated list of parking scofflaws which will be input into the
LPR database by the Jersey City Police Department It is understood between
the parties that the installation of vehicle immobilization devices by the Jersey
City Police Department shall only occur when it is practical to do and does not
impede the goals of. the police department Installa'ton of the vehicle
.immobilization device during hours thatthe Jersey City Parking Authority.is not in
.. operation shall be left solely to the discretion of supervisory members of the
Police Department Installation of a vehicle. imm,obilization device during hours
that the Parking Authority is in operation shall be done solely by personnel of the
Parking Authority. All removals of vehicle immobilzation devices shall be
performed .by personnel of the Parking Authority.
Article 2
Term of
Agreement
The term of this Agreement shall be August 1, 2011 through July 31,2012. This
. agreement shall renew automatically for a yearly term unless written notice is
served by the terminating party. Either party shall have the right to terminate this
agreementwith or without cause, for any or no reason whatsoever, upon 30 day
written notice to the other party.
Article 3
Compensation and Payment
No money shall be exchanged between the parties in exchange for this,
agreement If any payment is due pursuant to N.J.S.A. 40A:65-6, the Jersey
City Parking Authority shall pay the City of Jersey City within thirty (30) days of
the presentation of a bill by the City òf Jersey City.
Article 4
Contractual Relationship
1. In performing the services under this Agreement, the Jersey City Parking
Authority and the Jersey City Police Department shall. operate and have the
status of an independent contractor and shall not act as an agent or employee of
each otheL As independent contractors, the parties shall be solely responsible
determining the means and methods of performing -the services described in
for
the Scope of Services.
