Article 1<br />

Purpose and Scope of Agreement<br />

The purpose of this Agreement is for the <strong>Jersey</strong> <strong>City</strong> Police Department to share<br />

the.use of their License Plate Recognition Technology (LPR) with the <strong>Jersey</strong> <strong>City</strong><br />

Parking Authority through the inclusion in the data base of the LPR parking<br />

scofflaws. The use and operation of the LPR shall be done in a manner<br />

consistent with the Guideline on the use of LPR as. set out by the Attorney<br />

General for the State of New <strong>Jersey</strong>. The <strong>Jersey</strong> <strong>City</strong> Parking Authority shall<br />

regularly prepare an updated list of parking scofflaws which will be input into the<br />

LPR database by the <strong>Jersey</strong> <strong>City</strong> Police Department It is understood between<br />

the parties that the installation of vehicle immobilization devices by the <strong>Jersey</strong><br />

<strong>City</strong> Police Department shall only occur when it is practical to do and does not<br />

impede the goals of. the police department Installa'ton of the vehicle<br />

.immobilization device during hours thatthe <strong>Jersey</strong> <strong>City</strong> Parking Authority.is not in<br />

.. operation shall be left solely to the discretion of supervisory members of the<br />

Police Department Installation of a vehicle. imm,obilization device during hours<br />

that the Parking Authority is in operation shall be done solely by personnel of the<br />

Parking Authority. All removals of vehicle immobilzation devices shall be<br />

performed .by personnel of the Parking Authority.<br />

Article 2<br />

Term of<br />

Agreement<br />

The term of this Agreement shall be August 1, 2011 through July 31,2012. This<br />

. agreement shall renew automatically for a yearly term unless written notice is<br />

served by the terminating party. Either party shall have the right to terminate this<br />

agreementwith or without cause, for any or no reason whatsoever, upon 30 day<br />

written notice to the other party.<br />

Article 3<br />

Compensation and Payment<br />

No money shall be exchanged between the parties in exchange for this,<br />

agreement If any payment is due pursuant to N.J.S.A. 40A:65-6, the <strong>Jersey</strong><br />

<strong>City</strong> Parking Authority shall pay the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> within thirty (30) days of<br />

the presentation of a bill by the <strong>City</strong> òf <strong>Jersey</strong> <strong>City</strong>.<br />

Article 4<br />

Contractual Relationship<br />

1. In performing the services under this Agreement, the <strong>Jersey</strong> <strong>City</strong> Parking<br />

Authority and the <strong>Jersey</strong> <strong>City</strong> Police Department shall. operate and have the<br />

status of an independent contractor and shall not act as an agent or employee of<br />

each otheL As independent contractors, the parties shall be solely responsible<br />

determining the means and methods of performing -the services described in<br />

for<br />

the Scope of Services.<br />
