RESOLUTION AUTHORIZING THE PRIVATE SALE OF A VEHICLE<br />

FROM THE DEPARTMENT OF PUBLIC WORKS TO A NONPROFIT<br />

S01(C)(3) CORPORATION, HOME FOR GOOD DOG RESCUE, INC.<br />

COUNCIL offered and moved adoption of the following Resolution:<br />

WHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong>'s Deparment of Public Works (Deparent) O\"11S a 2002<br />

white Fonl EISO van, bearing vehicle identification number IFTRE14282HB79S47, ("the<br />

Property"), which is no longer needed for muncipal purposes; and<br />

WHEREAS, the Deparment has indicated that the value of the van is $L,SOO; and<br />

WHEREAS, Home for Good Dog Rescue, Inc. (HGDR) iocated at 35 Fairview Avenue,<br />

Su.'lmit, NJ 07901, is a non profit Section SOL (c)(3) organization whose purpose is to rescue<br />

dogs from death row in kil shelters, and to nurre and adopt dogs of all breeds into loving<br />

fàmilies and homes; and<br />

WHEREAS, HGDR has requested that the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> (<strong>City</strong>) consider donating the<br />

Property to HGDR because of its criticàlneed for a safe, affordable vehicle to transport dogs to<br />

the veterinarian and for use for adoption events; and<br />

WHEREAS, NJ.S.A. 40A:l2-2Ll provides that when personal property owned by the<br />

municipality is no longer needed ròr municipal pmposes, it may be sold for nominal<br />

consideration at a pnvate sale without compliance with any<br />

other law governing the disposal of<br />

personal propert to the any organizationlistëd under NJ.S .A. 40A: l2-21; and<br />

WHEREAS, N.J.S.A. 40A:12-21(e) authorizes the private sale of<br />

municipal property.no longer<br />

needed for muncipal purposes for nominal consideration to a non-profit animal shelter; and<br />

WHEREAS, the <strong>City</strong> has determined that it is in its best interests to sell<br />

strictly in its "as is" condition without iuy warranty whatsoever.<br />

NOW, THEREFORE, BE IT RESOLVED, by the Municipal Council of<br />

<strong>City</strong> that tle purchasing agent is hereby authorized to execute such documents as may be<br />

necessar in order to sell the vehicle for one dollar to HGDR subject to the following terms and<br />

conditions:<br />

J. HGDR shall agree to hold the <strong>City</strong> harmless for any damages and all present orfJture<br />

claims againstthe <strong>City</strong> arising out of the organization's ov,'Dership and operatiol1uf said<br />

vehicle.<br />

2. HGDR shall b.ear and pay any and aH costs or expenses which may be incurred in the<br />

transfer of title and ownership of such vehicle to the organization.<br />

3. HGDR shall at all times use and maíntain said vehicle soielv for t.lie specific purpose<br />

related to transport of dogs and related services and not tÖr~.ny commercial business,<br />

trade or manufacturing purpose,<br />

4. The <strong>City</strong> reserves the right that if the vehicle is not used in ac.:ordance with the specific<br />
