RESOLUTION AUTHORIZING THE PRIVATE SALE OF A VEHICLE
FROM THE DEPARTMENT OF PUBLIC WORKS TO A NONPROFIT
S01(C)(3) CORPORATION, HOME FOR GOOD DOG RESCUE, INC.
COUNCIL offered and moved adoption of the following Resolution:
WHEREAS, the City of Jersey City's Deparment of Public Works (Deparent) O\"11S a 2002
white Fonl EISO van, bearing vehicle identification number IFTRE14282HB79S47, ("the
Property"), which is no longer needed for muncipal purposes; and
WHEREAS, the Deparment has indicated that the value of the van is $L,SOO; and
WHEREAS, Home for Good Dog Rescue, Inc. (HGDR) iocated at 35 Fairview Avenue,
Su.'lmit, NJ 07901, is a non profit Section SOL (c)(3) organization whose purpose is to rescue
dogs from death row in kil shelters, and to nurre and adopt dogs of all breeds into loving
fàmilies and homes; and
WHEREAS, HGDR has requested that the City of Jersey City (City) consider donating the
Property to HGDR because of its criticàlneed for a safe, affordable vehicle to transport dogs to
the veterinarian and for use for adoption events; and
WHEREAS, NJ.S.A. 40A:l2-2Ll provides that when personal property owned by the
municipality is no longer needed ròr municipal pmposes, it may be sold for nominal
consideration at a pnvate sale without compliance with any
other law governing the disposal of
personal propert to the any organizationlistëd under NJ.S .A. 40A: l2-21; and
WHEREAS, N.J.S.A. 40A:12-21(e) authorizes the private sale of
municipal property.no longer
needed for muncipal purposes for nominal consideration to a non-profit animal shelter; and
WHEREAS, the City has determined that it is in its best interests to sell
strictly in its "as is" condition without iuy warranty whatsoever.

NOW, THEREFORE, BE IT RESOLVED, by the Municipal Council of
City that tle purchasing agent is hereby authorized to execute such documents as may be
necessar in order to sell the vehicle for one dollar to HGDR subject to the following terms and
conditions:
J. HGDR shall agree to hold the City harmless for any damages and all present orfJture
claims againstthe City arising out of the organization's ov,'Dership and operatiol1uf said
vehicle.
2. HGDR shall b.ear and pay any and aH costs or expenses which may be incurred in the
transfer of title and ownership of such vehicle to the organization.
3. HGDR shall at all times use and maíntain said vehicle soielv for t.lie specific purpose
related to transport of dogs and related services and not tÖr~.ny commercial business,
trade or manufacturing purpose,
4. The City reserves the right that if the vehicle is not used in ac.:ordance with the specific
