CERTIFIED PRODUCTS FOR PARTS AND REPAIRS FOR R
MAINTENANCE EQUIPMENT UNER STATE CONTRACT FOR T
DIVISION OF AUTOMOTIVE SERVICES

ADOPTION OF THE FOLLOWIG RESOLUTION:
OFFERED AND MOVED
WHEREAS, pars and repairs for road maintenance equipment are needed to keep the
City of Jersey City's (City) vehicles operational; and
WHEREAS, N.J.S.A. 40A:11-12 of the Local Public Contracts Law authorizes
municipalities to use a State contract without public bidding and N.J.A.C. 5:34-7.29(c) requires
City Council authorization for contracts exceeding $36,000.00; and
WHEREAS, Certified Products Co., Inc., 400 Westside Avenue, Jersey City, New Jersey
07305, being in possession of State contract A 69708 submitted a proposal for pars and repairs
for 't~ous City vehicles; and
WHEREAS, the contrct term shall be for six (6) months and the total cost of the
contract shall not exceed $50,000.00; and
WHEREAS, fuds in the amount of $20,000.00 are available in Automotive Operating
Account No. 11-01-201-26-315~310.
NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the City of
Jersey City that:

1) A contract is awarded to Certified Products Co., Inc. for pars and repairs for
road maintenance equipment for varous City vehicles;
2) The contract term is for six (6) months beginng on July 1, 2011, and the
maximum amount of the contract shall not exceed $50,000.00;
3) Ths contract is awarded without public bidding pursuat to N.J.S.A. 40A:11-
12;
4) Pursuant to NJ.A.C. 5:30-5.5(a), the continuation of the contrct afer the
expenditure of fuds encumbered in the 2011 calendar year temporary budget
shall be subject to the availability and appropriation of suffcient funds in the
2011 calendar year permanent budget;
5) Upon certification by an official or employee of the City authorized to receive
the material pursuant to the contract, that the same has been received and that
the requirements of the contract met, then; payment to the contractor shall be
made in accordance with the provisions of the Local Affairs Law, N.J.S.A.
40A:5-1i;~; and
6) This contract award shall be subject to the condition that the vendor provides
;r-A. satisfactory evidence of compliance with the Affrmative Action Amendments
1¡r3l11 to the Law Against Discrimination, NJ.S.A. 10:5-31 i;~.
