RESOLUTION AWARDING A PROFESSIONAL SERVICE AGREEMENT TO ERIC.
BERNSTEIN, ESQ. TO PROVIDE LEGAL SERVICES TO THE CITY OF JERSEY CITY
IN CONNECtION WITH LITIGATION, LABOR AND EMPLOYMENT MATTERS
WHEREAS, the City ofJersey City requires the services of Eric Bernstéin, Esq. of Bernstein & Associates to
represent the City of Jersey City in Litigation Labor and Employment matters; and
WHEREAS, Eric Bernstein, Esq. 2 North Road, Warren, New Jersey is an attorney-at-law with the State of
New Jersey and qualified to perform these services and wil provide these services at the rate of $125 per
hour, including expenses, not to exceed $125,000; and
WHEREAS, N.r.S.A.19:44A-20.4 gl ~.(the Pay-to-Play Law) took effect on January 1,2006; and
WflEREAS, in March 2009, the City publicly advertised a Request for Qualifications (RFQ) using the "fair
and open process" as described under the Pay-to-Play Law; and
WHEREAS, Bernstein & Assoc!atès submitted a Qualification Statement in response to the City's RFQ and
WHEREAS, this contract is made in accordance with the "fair andopen process" of the Pay~to-Play Law; and
WI:EREAS, funds irt the amount of $20.,000 are available in tl:e 2010 fiscal year. temporary budget in Account
No.: 10-01-201-20-155-312.
NOW, THEREFORE, BElT RESOL VEDby the Municipal CounCil of the City of Jersey City that:
1.. An ~greement is awarded to Eric Bernstein, Esq. of Bernstein & Associates, 2 North Road, Warren, .
New Jersey to provide legal services to the City of Jersey City in connection with litigation, labor and
employment matters.

2. A copy of this resólution wil be. published in a newspaper of general circulation in the City of
. Jersey City as required by law within (10) days of the adoption of the resolution.
3. This contract shall be subject to the condition that. the vendor provides satisfactory evidence óf
compliance with the Affirmative Action Amendments to the Law AgainstDiscrimination, N.r.S.A. 10:5-31 gl
seq.
4. The agreement shall be substantially in the form attached subject to such modifications as tle
Bttsiness Administrator stall deem appropriate and necessary.
