c. . Adherence to the standards contained in the applicable state laws and regulations does not relieve the<br />

.Subgrantee of the contractual responsibilties arsing under its procurements. The Subgrantee is the<br />

responsible authority, without recourse to OHSP, regarding the settement and satisfaction of all<br />

contractual and admitrative issues aring out of procurement entered in support of a grant.<br />

D. Should a Subgrantee purchase authoried equipment for another agency (public or private), or should<br />

. the Subgrantee reimburse another agency for acquired authoriedequipinent utiling HSGP fuds in<br />

the amount of$5,OOO or greater, a memorandum ofunderstanding (MOD) shallbe formalyprepared<br />

and signed by aÌ participating paries indicating use, maitenance and disposition 0 f said equipment.<br />

XV. Monitoring of Prngram Penormance.<br />

A. Subgrantee monitorig must cover each program function or activity to monitor pèrfonIance under<br />

grant<br />

supported activities to assure time schedules and objectives are being met, projected work unts<br />

by time periods are being accoriplihed and other performance goals are being achieved as applicable.<br />

B. The Subgrantee shall inform OHSP of the following types. of conditions which affect program<br />

objectives and performance as soon as they become known.<br />

1. Problems, delays or adverse conditions whìch wil materially impai the abilty to attain<br />

program objectives, prevent meeting time schedules and goals or preclude the attainent of<br />

project work. units by establihig time periods.. Thi disclosure shall be accompaned by a<br />

statement ofthe action taken, or contemplated, and any OHSP assistance required to resolve<br />

the situation.<br />

2. Favorable developments or events which enable meeting time schedules and goal sooner than<br />

. anticipated, at a lower than anticipated cost, or prodi:ces a grater benefit than originally<br />

3. Any excesS funds wil be returned to OHSP.<br />

c. OHSP may, upon reasonable'notice, make site visits for any ofthe fòllowing purposes.<br />

1. To review program áccomplihments and management control systems.<br />

2. To provide such techncal assistance as may be required.<br />

3. To pedorm fical reviews to ensure grant funds are being properly expended in a timely<br />

maner.<br />

XVI. Financial and Penormance Reporting.<br />

~. . Your agency wil be required to provide bianual strategy implementation reprts (BSIR) designed to<br />

outlie how thi grant fuding is being used to meet the goals and objectives. outlied in the state and<br />

urban area homeland security strategies. The awarding of these funds is conditioned upon your<br />
