. SUBJECT Lafayette Pool Complex - Completion Project<br />

Project # 2006-018<br />

Re:FenceWork<br />

1. Resolution 11-301, approved on May 11,2011, declared APS Contractors, Inc. (APS) in<br />

default of its contract with the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> (<strong>City</strong>) for the project known as Lafayette .<br />

Pool Complex, Project Nö. 2006-018.<br />

2. On May 12, 2011, the <strong>City</strong> sent APS a notice of default and termination of contract because<br />

of APS' s refusal to perform corrective work involving the pool plaster.<br />

3. The <strong>City</strong> needed to have. the Lafayette Pool Complex operational for the 2011 summer<br />

season.<br />

4. After the contract with APS was terminated, there was fence work that need to be completed<br />

before the pool could be opened to the public.<br />

. 5. OnJune21, 2011, a contract in the amountof$18,450.00 was awarded to Hamilton Services<br />

to complete the fence work so that the pool could be opened by Jtiy 1, 2011.<br />

6. . I certify that the foregoing statements are true. I am aware that if any of the foregoing<br />

. statements made by me are wilfully false, I am subject to punishment.<br />
