TITLE:<br />

RESOLUTION RATIFYIG AN EMERGENCY CONTRACT WITH<br />

HAMILTON SERVICES, LLC. FOR VAROUS FENCE WORK AT THE<br />

LAFAYETTE POOL COMPLEX FOR THE DEPARTMENT OF PUBLIC<br />

, WORK, DIVSION OF ARCIlTECTURE<br />

COUNCIL OFFERED AND MOVED ADOPTION OF THE FOLLOWING RESOLUTION:<br />

WHEREAS, by Resolution 11-301 approved on May 11,2011, the <strong>City</strong>of<strong>Jersey</strong> <strong>City</strong> (<strong>City</strong>)<br />

declared APS Contractors, Inc. (APS) in default of its contract with the <strong>City</strong> for the project known<br />

as Lafayette Pool Complex, Project No. 2006-018; and<br />

WHEREAS, on May 12, 201l, the <strong>City</strong> sent APS a notice of default and termination of<br />

contract because uf APS's refusal to perform corrective work involving the pool plaster; and<br />

WHREAS, APS began performng the contract in July 2009 and the <strong>City</strong> needs to have the<br />

Lafayette Pool Complex operational for the 20 11 sumer season; and<br />

WHREAS, since APS was declared in default and there were several areas offencing that<br />

needed to be addressed before the facilty could be opened such as reinorcing the fencing with tiebacks<br />

to reduce rackig; repaiing all gate closers and latches so that they are operational; and<br />

wirebrushing, priming and paiting all rusted areas. The fence work required two (2) weeks time<br />

to complete; and<br />

WHEREAS, the Division of Architectue solicited thee (3) proposals for the abovementioned<br />

work:<br />

$18,450.00<br />

$29,140.00<br />

$29,980.00<br />

WHEREAS, Hamilton Services, LLC (Hamilton), P.O. Box 1153, Denvile, New <strong>Jersey</strong><br />

07834 agreed to provide services for various fence repairs at the Lafayette Pool for a total contract<br />

amount of $18,450.00; and<br />

WHREAS, the <strong>City</strong> is acquiring these services as a statutorily permitted contract pursuant<br />

to the provisions ofN.J.S.A 19:44A 20.4 ~~. (pay-to-Play Law); and<br />

WHEREAS, the Director of Architectue has determined and certified in wrting that the<br />

value of the contract will exceed $17,500.00;, and<br />

WHREAS, Hamilton has completed and submitted a Business Entity Disclosure<br />

Certification which certfies that Hamilton has not made any reportble contrbutions to the political<br />

or candidate commttees listed in the Business Entity Disclosure Certification in the previous one<br />

year, and that the contract will prohibit Hamilton :fom making any reportable contributions during<br />

the term of the contract; and<br />

WHEREAS, Hamilton has submitted a Chapter 271 Political Contribution Disclosure<br />

Certification at least 10 days prior to the award of this contract; and<br />

WHEREAS, Hamilton has submitted its O~rtification of Compliance with the <strong>City</strong>'s<br />

Contractor Pay-to-Play Refonn Ordinance 08-l28 adopted on September 3,2008; and
