Acquiring<br />

7.1 Acquirer Obligations and Activities<br />

Each Payment Facilitator must regularly ensure that each of its<br />

Sub-merchants is provided with all materials necessary to effect Transactions<br />

in accordance with the Standards and to signify <strong>Maestro</strong> acceptance. These<br />

materials may include sales slips, credit slips, terminals, authorization<br />

services, <strong>Maestro</strong> acceptance decals, signage, and the like.<br />

6. Sub-merchant Monitoring<br />

Each Payment Facilitator must monitor on an ongoing basis the activity<br />

and use of the Marks of each of its Sub-merchants for the purpose of<br />

deterring fraudulent and other wrongful activity and to ensure ongoing<br />

compliance with the Standards. For purposes of this Rule, the minimum<br />

Merchant monitoring Standards set forth in this rulebook apply with respect<br />

to Sub-merchants.<br />

7. Sub-merchant Identification to Cardholders<br />

Each Payment Facilitator must ensure that, if the Cardholder is linked to a<br />

Payment Facilitator’s Web site from a Sub-merchant’s Web site for payment,<br />

the name of the Payment Facilitator must appear in DE 43 (Card Acceptor<br />

Name/Location), subfield 1 (Card Acceptor Name) in conjunction with<br />

the name of the Sub-merchant. If the Cardholder accesses the Payment<br />

Facilitator’s Web site directly, and its name is visible to the Cardholder<br />

throughout the Transaction from selection of goods and/or services to the<br />

completion of the checkout process, then the Payment Facilitator’s name<br />

may appear in DE 43 without the name of the Sub-merchant.<br />

7.1.4 ATM Owner Agreement<br />

Each Acquirer must have a written agreement (the “ATM Owner Agreement”)<br />

with the owner of every ATM from which it intends to acquire Transactions,<br />

whether such Transactions are submitted to the Acquirer by the ATM owner,<br />

or through a Service Provider acting for or on behalf of such Acquirer. If an<br />

Acquirer uses an MSP, the Acquirer must itself execute a written agreement<br />

directly with each ATM owner.<br />

The ATM Owner Agreement must be updated as appropriate to reflect the<br />

services provided by the ATM owner and may not contradict, or be inconsistent<br />

with, the Standards.<br />

The Acquirer must maintain the executed version of the ATM Owner Agreement<br />

and must make it available to the Corporation upon request.<br />
