14.3 General Obligations<br />

14.3.7 Use of the Marks<br />

A Service Provider must not use any Mark on its own behalf, whether in<br />

connection with Program Service or otherwise. The Service Provider may not<br />

suggest or in any manner create an impression that the Service Provider is a<br />

Customer or a representative of the Corporation, or that the Service Provider is<br />

anything other than a Service Provider of the Customer. The Service Provider<br />

must not create an impression that the Corporation in any way endorses the<br />

Service Provider or the Program Service the Service Provider performs.<br />

The Service Provider may use one or more of the Marks in connection with the<br />

Program Service it performs, provided:<br />

1. the Marks are used in accordance with the Standards, including all<br />

reproduction, usage, and artwork Standards that may be in effect from<br />

time to time;<br />

2. the Marks are used according to the express written instructions of the<br />

Customer; and<br />

3. the Marks are used solely in connection with the provision of Program<br />

Service.<br />

The Service Provider may use the Marks on its stationery, letterhead, or<br />

business cards only if accompanied, in close proximity, by a clear statement<br />

that identifies the Service Provider as an agent for a Customer and that includes<br />

the Customer’s name by which the Customer identifies itself to the public (for<br />

example, “Service Provider is an authorized representative of Bank XYZ”).<br />

14.3.8 Service Provider Identification on a Card<br />

The name of a non-Customer Service Provider may appear on a Card only if<br />

that Service Provider does not provide acquiring Program Service for or in<br />

connection with any Customer Program or Activity.<br />

14.3.9 Program Materials<br />

A Customer must approve all Program documents and other materials before any<br />

distribution, disclosure or other use thereof by a Service Provider. The Program<br />

materials may not state or imply that the Service Provider is participating<br />

in, or conducting any activity not expressly permitted by the Standards.<br />

Program materials include, by way of example, Merchant applications, Card<br />

applications, Merchant Agreements, ATM deployment agreements, Cardholder<br />

agreements, Merchant statements, Cardholder statements, marketing materials<br />

and Cardholder Communications, including Solicitations.<br />
