3.6 Non-discrimination<br />

Any entity that is eligible to become a Customer in one of the SEPA countries<br />

may request a SEPA License.<br />

The Standards applicable to other Licenses also apply to SEPA Licenses, unless<br />

otherwise provided.<br />

The SEPA License may be granted to Principals or Affiliates. The holder of a<br />

SEPA Principal License may sponsor Affiliates in one or more SEPA countries.<br />

The Affiliates may receive either a SEPA Affiliate License or a standard Affiliate<br />

License for the Marks.<br />

If a SEPA License is held by a Customer that will undertake activities in one<br />

or more SEPA countries via separate legal entities, the separate legal entities<br />

must also sign Licenses.<br />

The SEPA License may cover all of the countries in SEPA. If the SEPA License<br />

will cover both Switzerland and an EEA country, any Customer legal entity or<br />

SEPA Licensee that will be active both in Switzerland and in an EEA country<br />

must be regulated both in Switzerland and in an EEA country. The holder of a<br />

SEPA License must meet all local legal requirements in each country in which it<br />

intends to undertake activities.<br />

The Customer is assigned a separate ICA for each SEPA country in which it<br />

is active, must use that ICA only for its Activity in that country, and must<br />

not undertake Activity in that country before the relevant ICA has been<br />

implemented.<br />

The Customer is assigned a separate BIN or BIN range for each SEPA country in<br />

which it is active, must use that BIN or BIN range only for its Activity in that<br />

country, and must not undertake Activity in the country before the relevant BIN<br />

or BIN range has been implemented. For Card issuance, different ranges within<br />

a BIN may be linked to ICAs assigned for different SEPA countries.<br />

With regard to Intracountry Transactions, the holder of a SEPA License must<br />

respect the applicable intracountry rules and fees.<br />

3.6 Non-discrimination<br />

In addition to Rule 3.6 of Chapter 17, the following Rule applies within SEPA:<br />

A Customer must not, directly or indirectly, prevent or discriminate against the<br />

use of <strong>Maestro</strong> as a brand for Intracountry or Intra-SEPA Transactions.<br />
