RCRA also addresses the transportation <strong>of</strong> hazardous waste (40 CFR 263). Any transporter<br />

<strong>of</strong> hazardous waste must also comply with the Department <strong>of</strong> Transportation (DOT)<br />

rules under the Hazardous Materials Transportation Act (HMTA) regarding proper labeling,<br />

packaging, handling, and placarding. 47<br />

Finally, a facility generating waste can determine if its waste is regulated under Subtitles<br />

C or D by following the steps outlined in the Code <strong>of</strong> Federal Regulations, Title 40 Part<br />

260, Appendix I (see Figures 19.4, 19.5, and 19.6).<br />

Other provisions exist if the solid waste will be incinerated.<br />

19.5 MULTIMEDIA LAWS AND REGULATIONS<br />

19.5.1 POLLUTION PREVENTION ACT OF 1990 3<br />

19.5.1.1 Background<br />

Before 1990, most regulations in the U.S. were issued based on the use <strong>of</strong> conventional pollution<br />

management practices usually considering waste management and end-<strong>of</strong>-pipe control<br />

technologies. Only a handful <strong>of</strong> government activities were considering reduction <strong>of</strong><br />

pollution at the source. In the area <strong>of</strong> waste minimization, recycling approaches were employed<br />

in addition to add-on control technology to achieve pollution reduction. However,<br />

reducing pollution at the source refers to the top <strong>of</strong> the hierarchy. Although add-on control
