3.1. a language of compactly living old migrants who hold citizenship<br />

of a state (a language of diasp<strong>or</strong>a);<br />

3.2. a language of non-compactly settled old migrants who hold citizenship<br />

of a state (a language of diasp<strong>or</strong>a);<br />

3.3. a language of new migrants without citizenship.<br />

Languages": Protecting Native Languages of Hist<strong>or</strong>ical<br />

Min<strong>or</strong>ities<br />

As it is stated in the Preamble of the <strong>Charter</strong>, "the protection of<br />

the hist<strong>or</strong>ical regional <strong>or</strong> min<strong>or</strong>ity languages of Europe, some of which<br />

are in danger of eventual extinction, contributes to the maintenance and<br />

development of Europe's cultural wealth and traditions".<br />

The first paragraph of the Explanat<strong>or</strong>y Rep<strong>or</strong>t states that "Many<br />

<strong>European</strong> countries have on their territ<strong>or</strong>y regionally based autochthonous<br />

groups 344 speaking a language other than that of the maj<strong>or</strong>ity of the<br />

population. This is a consequence of hist<strong>or</strong>ical processes whereby the<br />

<strong>f<strong>or</strong></strong>mation of states has not taken place on purely language-related lines<br />

and small communities have been engulfed by larger ones 345<br />

."<br />

The nature of the principal goal of the <strong>Charter</strong> is culturalhumanitarian.<br />

It has an objective to protect and contribute to the maintenance<br />

and development of regional <strong>or</strong> min<strong>or</strong>ity languages as an integral<br />

part of the common <strong>European</strong> cultural heritage… It aims to ensure the use<br />

of regional <strong>or</strong> min<strong>or</strong>ity languages in the system of education and mass<br />

media to the extent possible; to promote the creation of literature and literary<br />

culture in these languages, to ensure their used in the activities of le-<br />
