of implementation of the "<strong>European</strong> <strong>Charter</strong> <strong>f<strong>or</strong></strong> <strong>Regional</strong> <strong>or</strong> Min<strong>or</strong>ity<br />

Languages" by Russian occupant regime. Ge<strong>or</strong>gian jurisdiction must be<br />

rest<strong>or</strong>ed in Apkhazeti and Tskhinvali region.<br />

Thus, the "<strong>European</strong> <strong>Charter</strong> <strong>f<strong>or</strong></strong> <strong>Regional</strong> <strong>or</strong> Min<strong>or</strong>ity Languages"<br />

in its sense is a clear and a high-level document; its provisions<br />

pose no danger <strong>f<strong>or</strong></strong> any country.<br />

In case of individual consideration of principles of the ECRML<br />

and the Hague and Oslo recommendations, without any harm to the<br />

state language in Ge<strong>or</strong>gia and other countries, it is possible to define the<br />

status of all existed linguistic entities and to protect the linguistic rights<br />

of representatives of principal population, hist<strong>or</strong>ical min<strong>or</strong>ities, new min<strong>or</strong>ities<br />

and migrants. The ECRML facilitates maintenance of linguisticcultural<br />

(national) heritage by the autochthonous – hist<strong>or</strong>ical (rather<br />

than new) min<strong>or</strong>ities who possess no state of their own <strong>or</strong> are within the<br />

<strong>f<strong>or</strong></strong>eign state boundaries. M<strong>or</strong>eover, the "<strong>European</strong> <strong>Charter</strong> <strong>f<strong>or</strong></strong> <strong>Regional</strong><br />

<strong>or</strong> Min<strong>or</strong>ity Languages" requires to pri<strong>or</strong>itize the languages of endangered,<br />

unprotected hist<strong>or</strong>ical min<strong>or</strong>ities 445<br />

.<br />

The provisions of the ECRML do not cover the languages of the<br />

"new min<strong>or</strong>ities" of the state in question; <strong>f<strong>or</strong></strong> this purpose, other international<br />

legal documents (the Hague and Oslo recommendations) are<br />

available.<br />

By taking into account the provisions of the ECRML, 7 types of<br />

languages could be considered:<br />

- a language of a traditional (autochthonous) principal population<br />

– a state language;<br />

- a language in autonomous <strong>f<strong>or</strong></strong>mation – the language of the autonomous<br />

<strong>f<strong>or</strong></strong>mation designated by its society – another state language in<br />

this <strong>f<strong>or</strong></strong>mation (which is the concern of the governments of the state and<br />

the autonomous <strong>f<strong>or</strong></strong>mation);<br />

- a language of a hist<strong>or</strong>ical, autochthonous ethnic min<strong>or</strong>ity; it<br />

must be protected by the state by taking into account Part III of the<br />

ECRML;<br />

- a language of a migrant ethnic gourp that settled in the state in<br />

question centuries ago, and which has no opp<strong>or</strong>tunity to be protected<br />

anywhere else. Depending on the goodwill of the state, this type of language<br />

could be covered by the provisions of Part II of the ECRML; in<br />
