The problem is complicated by the fact that international law contains<br />

no mutually agreed definitions <strong>f<strong>or</strong></strong> such terms as national min<strong>or</strong>ity,<br />

hist<strong>or</strong>ical national min<strong>or</strong>ity, new national min<strong>or</strong>ity, diasp<strong>or</strong>a, old migrant,<br />

new migrant, etc.; though the definitions have shared features: <strong>f<strong>or</strong></strong><br />

instance, different considerations of specialists on "national min<strong>or</strong>ities"<br />

share general "framew<strong>or</strong>k" of definition: a national min<strong>or</strong>ity is a nondominant<br />

part of permanently residing population in the country in<br />

question, which differs from the maj<strong>or</strong>ity of population by its ethnic, religious<br />

and linguistic features and which strives to maintain its unique<br />

identity 435<br />

All persons who received citizenship will be regarded as "permanently<br />

residing" citizens, though is a group of suh persons considered as<br />

a national min<strong>or</strong>ity?<br />

There is an opinion which suggests considering the second and<br />

third generations of migrants as national min<strong>or</strong>ities .<br />

New migrants are protected by many international documents;<br />

naturally, they will be covered by neither the "<strong>European</strong> <strong>Charter</strong> <strong>f<strong>or</strong></strong> <strong>Regional</strong><br />

<strong>or</strong> Min<strong>or</strong>ity Languages" n<strong>or</strong> "Oslo recommendations".<br />

When taking into account the fact that isolatating-confronting the<br />

terms – "national min<strong>or</strong>ity" and "ethnic min<strong>or</strong>ity" seems to be artificial<br />

and that both integration process and the one aimed at maintaining identity<br />

are intensive in the moder-day w<strong>or</strong>ld, the following steps might be<br />

reasonable:<br />

To establish parallel terms: "migrated ethnic min<strong>or</strong>ity" i.e. diasp<strong>or</strong>a<br />

to denote old migrants who will be covered by the international<br />

documents stipulating "linguistic rights" (rather than – the "<strong>European</strong><br />

<strong>Charter</strong> <strong>f<strong>or</strong></strong> <strong>Regional</strong> <strong>or</strong> Min<strong>or</strong>ity Languages"); and, to apply term: "his-<br />
