§ A705 BROOME COUNTY ADMINISTRATIVE CODE § A802<br />

include but not necessarily be limited to the services, facilities and programs of the<br />

Tuberculosis Chest Clinic, physically handicapped persons and other public health facilities.<br />

Any clinic, dispensary, hospital or laboratory facilities relating to public health heretofore or<br />

hereafter established by a city, town or village and subsequently transferred to the <strong>County</strong> or<br />

heretofore or hereafter established by the <strong>County</strong> Legislature shall become a division or other<br />

subordinate part of the Department of Health as prescribed by the <strong>County</strong> Legislature.<br />

§ A706. Deputies.<br />

The Commissioner or Director of Health may, when such positions are authorized by the<br />

<strong>County</strong> Legislature, and within the budgetary appropriations provided therefor, appoint to<br />

serve at his pleasure such Deputies as he may deem necessary for the performance of his<br />

duties and to fulfill the purposes of Article III of the Public Health Law in the <strong>County</strong> or<br />

Part-<strong>County</strong> Health District. The Deputies shall have the qualifications prescribed by the New<br />

York State Sanitary Code and shall have the authority to act generally for and in place of the<br />

Commissioner or Director of Health. The designation or designations shall be in writing and<br />

filed in the Department of Records, and copies thereof shall be filed with the <strong>County</strong><br />

Executive and with the Clerk of the <strong>County</strong> Legislature.<br />

A<strong>RT</strong>ICLE VIII<br />

Department of Mental Health<br />

§ A801. Department of Mental Health; Commissioner; appointment; qualifications.<br />

There shall be a Department of Mental Health headed by a Commissioner. The method of<br />

choosing the Commissioner as well as his qualifications shall be as provided in § C801 of<br />

Article VIII of the Charter.<br />

§ A802. Powers and duties.<br />

The Commissioner of Mental Health shall have all the powers and duties and shall be subject<br />

to all the obligations and liabilities heretofore and hereafter lawfully granted or imposed by<br />

the Charter, this Code, local law, ordinance or resolution of the <strong>County</strong> Legislature, order or<br />

direction of the <strong>County</strong> Executive or any applicable provision of any act of the State<br />

Legislature not inconsistent with the Charter and Code. Such powers and duties, obligations or<br />

liabilities shall include, but shall not be limited to, any powers, duties, obligations or liabilities<br />

granted or imposed upon a Director of Community Mental Health Services and upon<br />

Community Mental Health Boards, except as otherwise provided by the Charter and Code.<br />

The Commissioner of Mental Health shall be in charge of and coordinate the Mental Health<br />

Clinic, alcohol and drug abuse programs and all other facilities, services and programs<br />

relating to community mental health heretofore or hereafter established by the <strong>County</strong><br />

Legislature.<br />
