§ A2303-A BROOME COUNTY ADMINISTRATIVE CODE § A2304-A<br />

of the amount appropriated for such fiscal year or for any other purpose except as<br />

otherwise provided in the Charter, this Code or the Local Finance Law.<br />

(b)<br />

The Board of Trustees shall have the authority to transfer funds within budgetary<br />

lines, except for the limitations on transfers of personnel and fringe benefits<br />

contained in the following paragraph, provided that said transfers are reported by<br />

the Trustees to the <strong>County</strong> Executive and the Clerk of the <strong>County</strong> Legislature on a<br />

monthly basis in a format designated by the Director of Budget and Research and<br />

the <strong>County</strong> Comptroller.<br />

The Board shall have the authority to transfer funds contained in personnel and<br />

fringe benefit lines up to a total of 5% of each division line per year. Any<br />

transfers from a personnel or fringe benefit line in excess of 5% per year shall be<br />

approved by the <strong>County</strong> Legislature.<br />

The Board shall report all transfers from personnel and fringe benefit lines to the<br />

<strong>County</strong> Executive and the Clerk of the Legislature in the format designated by<br />

the Director of Budget and Research and the <strong>County</strong> Comptroller.<br />

The Board of Trustees shall maintain control at all times over the expenditures of<br />

the college in accordance with the provisions of the <strong>County</strong> Charter and Code not<br />

inconsistent herewith.<br />

If at any time during the fiscal year it appears that the revenues available will be<br />

insufficient to meet the amounts appropriated, the Board of Trustees shall report to<br />

the <strong>County</strong> Executive and the <strong>County</strong> Legislature, without delay, the estimated<br />

amount of the deficit, the reasons therefor, the remedial action taken by the<br />

Trustees and their recommendations as to further action. The <strong>County</strong> Executive<br />

and <strong>County</strong> Legislature shall take such action as it deems necessary to prevent or<br />

minimize any deficit. For that purpose, the <strong>County</strong> Legislature and the <strong>County</strong><br />

Executive may reduce one or more appropriations to the college, provided that no<br />

appropriation may be reduced by more than the unencumbered balance thereof or<br />

below any amount required by law to be appropriated. The <strong>County</strong> Legislature and<br />

<strong>County</strong> Executive may also, if they so desire, borrow temporarily, pursuant to the<br />

Local Finance Law, in any amount not greater than such deficit for such purpose.<br />

§ A2304-A. College Treasurer.<br />

The College Treasurer shall have all of the powers and duties and shall be subject<br />

to all the obligations and liabilities heretofore or hereafter lawfully granted or<br />

imposed by state law, the Charter or local law adopted by the <strong>County</strong> not<br />

inconsistent with this Article, except that the Treasurer shall not be authorized to<br />

sell debt under the Local Finance Law.<br />

The Treasurer shall approve and certify all payrolls for salaries and compensate all<br />

college employees and offices. All original payrolls shall be filed with the Board<br />
