§ C1201 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE § C1302<br />

The Board of Acquisition and Contract shall contract for and acquire by purchase or<br />

condemnation all lands, buildings and other real property the acquisition of which has been<br />

authorized by the <strong>County</strong> Legislature and shall award all contracts for the construction,<br />

reconstruction, repair or alteration of all public works or improvements involving an<br />

expenditure of more than $7,000.<br />

§ C1202. Execution of contracts. [Amended 10-4-1983 by L.L. No. 16-1983; 10-15-1992<br />

by L.L. No. 12-1992; 5-15-2008 by L.L. No. 2-2008]<br />

All contracts, except for the puchase of equipment, supplies, materials and services incidental<br />

thereto, shall be executed on behalf of the <strong>County</strong> by the <strong>County</strong> Executive in accordance<br />

with the provisions of General Municipal Law § 103. Whenever such contract involves the<br />

expenditure of an amount greater than the limitation provided by General Municipal Law<br />

§ 103, except contracts for the acquisition of real property, the contracts shall be awarded to<br />

the lowest responsible bidder in a manner as set forth in the Administrative Code. A copy of<br />

each contract, when executed, shall be filed with the Comptroller, together with a copy of the<br />

local law, resolution or ordinance of the <strong>County</strong> Legislature upon which the right to make<br />

such contract rests, other than the annual appropriation act.<br />

§ C1203. Prequalification of bidders.<br />

If directed by the <strong>County</strong> Legislature, the Board of Acquisition and Contract shall require<br />

prequalification of bidders on any contract. Otherwise, the Board may require the<br />

prequalification of bidders on any contract, subject to such conditions as shall be established<br />

by the <strong>County</strong> Legislature.<br />

Department of Social Services<br />

§ C1301. Department of Social Services; Commissioner; appointment; qualifications.<br />

[Amended 4-4-1991 by L.L. No. 10-1991]<br />

There shall be a Department of Social Services, headed by a Commissioner who shall be<br />

appointed by the <strong>County</strong> Executive, subject to confirmation by the <strong>County</strong> Legislature, except<br />

that the person serving as Commissioner of Social Services at the time immediately prior to<br />

this Charter taking effect shall continue to serve as the Commissioner of the Department of<br />

Social Services until December 31, 1970, and thereafter the Commissioner of the Department<br />

of Social Services shall be appointed as provided herein for a term prescribed by the Social<br />

Services Law.<br />

The Commissioner shall be appointed on the basis of his administrative experience and his<br />

qualifications for the duties of the office as prescribed by the Social Services Law and the<br />

rules and regulations made pursuant thereto.<br />

§ C1302. Powers and duties.<br />

The Commissioner of Social Services shall:<br />
