B. Statements of policy and interpretations which have been adopted by the <strong>County</strong> of<br />

<strong>Broome</strong> and any statistical or factual tabulations which led to the formulation thereof.<br />

C. Minutes of public hearings held by the <strong>County</strong> of <strong>Broome</strong>.<br />

D. Internal or external audits and statistical or factual tabulations made by or for the <strong>County</strong><br />

of <strong>Broome</strong>.<br />

E. Administrative staff manuals and instructions to staff that affect members of the public.<br />

F. The payroll record.<br />

G. Any other files, records, papers or documents required by any provision of law to be<br />

made available for public inspection.<br />

RECORDS ACCESS OFFICER — The Clerk of the <strong>County</strong> Legislature as hereinbefore<br />

defined.<br />

WORKDAY — Any day except Saturday, Sunday, a public holiday or a day on which the<br />

<strong>County</strong> of <strong>Broome</strong> is otherwise closed for general business.<br />

§ 225-3. Procedure for obtaining records. [Amended 2-5-1980 by Res. No. 45; 9-3-1980<br />

by Res. No. 294; 6-24-1986 by Res. No. 201]<br />

A. The Clerk of the <strong>County</strong> Legislature shall be designated as the records access officer and<br />

shall be hereinafter referred to as the "officer." Any person wishing to inspect and/or<br />

obtain a copy of any record of the <strong>County</strong> of <strong>Broome</strong>, other than Department of Social<br />

Services records or records required to be open for public inspection by the New York<br />

State Election Law, may make application to the officer. Such application shall be in<br />

writing on a form to be prescribed by such officer. Blank forms may be obtained from<br />

the officer either personally on any workday at the office of the Clerk of the <strong>County</strong><br />

Legislature, <strong>County</strong> Office Building, Government Plaza, Binghamton, New York,<br />

between the hours of 9:00 a.m. and 5:00 p.m. or by letter addressed to such office<br />

enclosing a self-addressed first-class stamped envelope. Completed forms may be<br />

submitted to the officer either personally at such office on any workday between the<br />

hours of 9:00 a.m. and 5:00 p.m. or by mail addressed to the above office. Upon receipt<br />

of such an application, in the proper form and at the appropriate time, the officer shall do<br />

one of the following:<br />

(1) If the officer determines that the record requested is not in the custody of <strong>Broome</strong><br />

<strong>County</strong>, the officer shall:<br />

(a)<br />

(b)<br />

(c)<br />

Acknowledge receipt of the request; and<br />

Certify that the record does not exist or has been lost; or<br />

Advise the applicant that the record is in the custody of another specified<br />

agency.<br />
