§ C1602 BROOME COUNTY CHA<strong>RT</strong>ER § C1702<br />

§ C1602. Department of Personnel; Personnel Officer; appointment; term;<br />

qualifications.<br />

There shall be a Department of Personnel, headed by a Personnel Officer who shall be<br />

appointed by the <strong>County</strong> Executive. He shall serve for a term as provided by the Civil Service<br />

Law.<br />

The Personnel Officer shall be appointed on the basis of his administrative experience and his<br />

qualifications for the duties of the office. The Personnel Officer shall be appointed by the<br />

<strong>County</strong> Executive, subject to confirmation by the <strong>County</strong> Legislature, and shall serve at the<br />

pleasure of the <strong>County</strong> Executive. [Amended 4-4-1991 by L.L. No. 10-1991]<br />

§ C1603. Powers and duties.<br />

The Personnel Officer shall have, with reference to the civil service of the <strong>County</strong>, the powers<br />

and duties of a <strong>County</strong> Personnel Officer as provided in the Civil Service Law, and he shall<br />

be subject to such supervision and control by the State Civil Service Commission as are<br />

<strong>County</strong> Personnel Officers. He shall perform such other and related duties as shall be required<br />

of or delegated to him by the <strong>County</strong> Executive or the <strong>County</strong> Legislature.<br />

Department of Law<br />

§ C1701. Department of Law; <strong>County</strong> Attorney; appointment; qualifications.<br />

There shall be a Department of Law, headed by a <strong>County</strong> Attorney who shall be appointed by<br />

the <strong>County</strong> Executive, subject to confirmation by the <strong>County</strong> Legislature, and shall serve at<br />

the pleasure of the <strong>County</strong> Executive.<br />

§ C1702. Powers and duties.<br />

The <strong>County</strong> Attorney shall:<br />

(A) Be the sole legal advisor for the <strong>County</strong>.<br />

(B) Advise all <strong>County</strong> officers and employees in all <strong>County</strong> legal matters of a civil nature.<br />

(C) Prosecute or defend all actions or proceedings of a civil nature brought by or against the<br />

<strong>County</strong>.<br />

(D) Prepare resolutions, ordinances, legalizing acts and local laws, together with notices and<br />

other items in connection therewith, to be presented for action by the <strong>County</strong><br />

Legislature. 9<br />

(E) Perform such other and related duties as may be prescribed by law, the <strong>County</strong> Executive<br />

or the <strong>County</strong> Legislature.<br />

followed this subsection, has been deleted since original Section 1703, Real Estate and Tax Map Office, was repealed<br />
