§ 52-4 RESERVE FUNDS § 52-8<br />

D. The uninsured portion of any loss to property owned by the <strong>County</strong> of <strong>Broome</strong> if such<br />

loss is one for which insurance is authorized pursuant to Subdivisions 4, 5, 6, 9, 10 and<br />

12 and Paragraph (A) of Subdivision 7 of § 46 of the Insurance Law, 1 and also,<br />

reimbursement under this subsection shall be in accordance with standard property<br />

insurance loss settlement practices as properly determined by the office of the <strong>County</strong><br />

Attorney.<br />

E. Expert or professional services rendered in connection with the investigation, adjustment<br />

or settlement of claims, actions or judgments, pursuant to contractual authorization by the<br />

Board of Acquisition and Contract.<br />

§ 52-5. Expenditure exceptions.<br />

A. Notwithstanding the provisions of § 52-4 of this Article, the county's Manager of Risk<br />

and Insurance may authorize an expenditure from this fund, without judicial approval, for<br />

the compromise or settlement of any claim where the amount of such settlement or<br />

compromise does not exceed $5,000.<br />

B. Notwithstanding the provisions of § 52-4 of this Article, the <strong>County</strong> Attorney may<br />

authorize an expenditure from this fund, without judicial approval, for the compromise or<br />

settlement of any claim or action where the amount of such settlement or compromise<br />

does not exceed $50,000.<br />

§ 52-6. Expenditure limit.<br />

No expenditure in excess of $50,000 may be made from this fund without the authorization of<br />

the Finance Committee of the <strong>County</strong> Legislature.<br />

§ 52-7. Accounting.<br />

Where an expenditure from the fund is authorized as provided herein:<br />

A. Payment shall be made upon the audit and warrant of the Comptroller; and<br />

B. Upon such audit and warrant, the Commissioner of Finance shall transfer the amount of<br />

such expenditure from the fund to the appropriate departmental budget line and shall<br />

thereupon debit such expenditure from said budget line.<br />

§ 52-8. Discontinuance.<br />

If, after the establishment of such fund, the <strong>County</strong> of <strong>Broome</strong> determines that such fund is no<br />

longer needed, the moneys remaining in such fund may be transferred to any other reserve<br />

fund of the <strong>County</strong> of <strong>Broome</strong> authorized by the General Municipal Law that is comprised of<br />

moneys which were raised on the same tax base as the moneys in the reserve fund established<br />

under this Article, only to the extent that the moneys in this fund shall exceed the sum<br />
