may provide for any subject matter of <strong>County</strong> concern not required to be provided by local<br />

law, legalizing act or resolution of the <strong>County</strong> Legislature.<br />

Such ordinance may provide for its enforcement by legal or equitable proceedings in a court<br />

of competent jurisdiction, may prescribe that violations thereof shall constitute offenses or<br />

misdemeanors and may provide for punishment of violations by civil penalty or by fine or<br />

imprisonment or by two (2) or more such penalties or punishments. Ordinances and their<br />

application, including particular subjects and form, may be further provided in the<br />

Administrative Code.<br />

A<strong>RT</strong>ICLE III<br />

Executive Branch<br />

§ C301. <strong>County</strong> Executive; election; term. [Amended 8-17-1976 by L.L. No. 3-1976;<br />

4-4-1991 by L.L. No. 10-1991]<br />

The Executive Branch of the <strong>County</strong> government shall be administered by the <strong>County</strong><br />

Executive.<br />

An elective <strong>County</strong> Executive shall be elected at the general election in November 1969 and<br />

shall serve for a three-year term. He shall thereafter be elected at the general election in<br />

November 1972 for a four-year term of office and shall be elected every fourth year<br />

thereafter.<br />

No elective official of any town, village, city, <strong>County</strong> or any other municipality shall be<br />

eligible to hold the office of <strong>County</strong> Executive.<br />

Effective January 1, 1977, the <strong>County</strong> Executive shall be required to give his whole time to<br />

the duties of his office and shall not engage in the practice of any profession or the conduct of<br />

any business, trade, occupation or employment. Nothing contained herein, however, shall<br />

preclude the <strong>County</strong> Executive from receiving income derived from personally held<br />

investments or securities, from rentals or from businesses, partnerships or corporations in<br />

which he may have an interest so long as he does not actively participate in the operation or<br />

conduct thereof.<br />

§ C302. Powers and duties.<br />

The <strong>County</strong> Executive, in addition to any other powers and duties provided by this Charter,<br />

shall:<br />

(A) Be the chief executive officer and administrative head of the <strong>County</strong> government.<br />

(B) Supervise and direct the internal organization and reorganization of each department or<br />

other administrative unit the head of which he has the power to appoint.<br />

(C) Be the chief budget officer of the <strong>County</strong> and be responsible for preparation of the<br />

operating and capital budgets of the <strong>County</strong>.<br />

(D) Determine and fix real property tax equalization rates among the various taxing districts<br />

of the <strong>County</strong> for <strong>County</strong> purposes and file the same with the <strong>County</strong> Legislature on or<br />
