§ 5-5 BROOME COUNTY CODE § 5-9<br />

§ 5-5. Adopt-A-Project agreements.<br />

Before any work is undertaken by the applicant on the proposed project, the applicant shall<br />

sign an Adopt-A-Project Agreement on a form to be provided by the <strong>County</strong>. The department<br />

head having jurisdiction over the project site the applicant proposes to adopt shall have the<br />

authority to enter into Adopt-A-Project agreements with the applicant.<br />

§ 5-6. Erection of signs.<br />

After a period of not less than six months, the applicant may request a review of the adopted<br />

project. If the project has been performed pursuant to the Adopt-A-Project Agreement, the<br />

department head responsible shall make arrangements for a sign to be placed at the project<br />

site stating that the project has been adopted by the applicant organization.<br />

§ 5-7. Termination of project agreement.<br />

If the applicant fails to perform the project as agreed to for a period of more than 60 days, the<br />

Adopt-A-Project Agreement shall be terminated, and any signage pursuant to the provisions<br />

herein shall be removed.<br />

§ 5-8. Participants not deemed <strong>County</strong> employees; <strong>County</strong> held harmless.<br />

A. The applicant organization and individual members of the organization performing any<br />

work or services pursuant to an Adopt-A-Project Agreement shall not be deemed to be<br />

employees of the <strong>County</strong> of <strong>Broome</strong> but merely volunteers. The applicant further agrees<br />

not to permit anyone under the age of 11 years to participate in this program.<br />

B. The <strong>County</strong> of <strong>Broome</strong> and its employees shall not be liable for damages suffered by any<br />

person, including the volunteer, resulting from the actions or activities of such volunteers<br />

or organization. Prior to commencing work on the project, all participants (or the<br />

guardian of the participant if the participant is under the age of 18) shall sign a release<br />

and waiver form.<br />

§ 5-9. Equipment.<br />

The <strong>County</strong> of <strong>Broome</strong> shall not supply any tools, equipment or supplies for this program.<br />

Any and all tools, equipment or supplies shall be furnished by the applicant.<br />
