§ A201 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE § A202<br />

18 Town of Vestal (Election Districts 1, 4, 5, 6, 7, 9, 11, 12, 13, 14, 21, 22)<br />

19 Town of Vestal (Election Districts 8, 10, 15, 16, 17, 20, 23, 24, 25, 27)<br />

Reference to "Election Districts" in the above description refers to Election Districts<br />

established as of February 15, 2002, except that those which the Town of Union and<br />

the City of Binghamton amended in 2006 are referenced by their amended Election<br />

District number.<br />

The maps of the districts referred to above, as well as maps showing the Legislative<br />

Districts into which <strong>Broome</strong> <strong>County</strong> is herein divided, shall be filed with the Clerk of<br />

the <strong>Broome</strong> <strong>County</strong> Legislature and shall remain on file and shall be considered and<br />

hereby made a part hereof.<br />

Effective January 1, 2013, the number of legislative districts in <strong>Broome</strong> <strong>County</strong> shall<br />

be decreased from 19 to 15. Upon release of the next decennial federal census, the<br />

<strong>County</strong> Legislature shall redraw legislative boundaries to provide for 15 legislative<br />

districts and by January 30, 2012, § A201(C) shall be amended to define the redrawn<br />

legislative districts. This amendment, which defines the redrawn legislative districts,<br />

shall be subject to a referendum on petition in the manner provided by the terms and<br />

provisions of § 24 of the Municipal Home Rule Law. <strong>County</strong> Legislators who will<br />

represent the electors of the re-drawn legislative districts shall be elected at the<br />

general election to be held in 2012 to take office on January 1, 2013.<br />

(D) Each <strong>County</strong> Legislator shall be a resident elector of the district he represents at the time<br />

of his nomination, his election and throughout his term of office. He shall also be a<br />

resident elector of the district he represents if he is appointed to fill a vacancy and<br />

throughout his term of office. No elective or appointive official of any town, village or<br />

city or any other municipality shall be eligible to hold office as a <strong>County</strong> Legislator.<br />

(E) After each federal decennial census, including that of 1980, the Clerk of the <strong>County</strong><br />

Legislature shall determine the results of said census, publicly announce such results and<br />

file the same with the <strong>County</strong> Legislature. The <strong>County</strong> Legislature shall thereupon<br />

reconsider its representation and, if necessary, redraw Legislative District boundaries.<br />

Any amendment to this Code reapportioning representation on the <strong>County</strong> Legislature<br />

shall be subject to a referendum on petition in the manner provided for by the terms and<br />

provisions of § 24 of the Municipal Home Rule Law.<br />

§ A202. Term of office.<br />

The term of office of a <strong>County</strong> Legislator shall be for two years and shall begin on the first<br />

day of January immediately succeeding his election.<br />
