§ 85-33 AIRPO<strong>RT</strong>: GROUND TRANSPO<strong>RT</strong>ATION SERVICES<br />

§ 85-35<br />

(1) Immediately revoke the permit issued to the entity or ground transportation<br />

services provider.<br />

(2) Exercise any other rights it may have pursuant to law.<br />

§ 85-34. Required insurance; minimum coverage types and amounts.<br />

A. Coverage type/minimum limits.<br />

(1) Automobile liability: the minimum(s) as prescribed by the laws of New York<br />

State; comprehensive form; must cover owned, nonowned and hired vehicles.<br />

(2) Workers' comprehensive and employer's liability: $100,000 (statutory amount). In<br />

lieu of a worker's compensation policy, a waiver issued by the New York State<br />

Workers' Compensation Board may be submitted.<br />

B. The certificate face shall:<br />

(1) Indicate coverages and minimum amounts required in § 85-34A.<br />

(2) Provide that the coverages shall not be cancelled, terminated or materially changed<br />

(including reduction of coverage amounts) until at least 30 days' prior written<br />

notice has been given to the <strong>Broome</strong> <strong>County</strong> Office of Risk and Insurance.<br />

C. The certificate holder should read:<br />

§ 85-35. Defense and indemnification.<br />

A. The entity or ground transportation services provider to whom a permit is issued pursuant<br />

to this chapter agrees to indemnify and hold the <strong>County</strong> of <strong>Broome</strong> and any officer,<br />

employee and/or agent thereof free and harmless from any and all loss(es), penalty(ies),<br />

damages, settlement(s), cost(s), charge(s), professional fee(s) or other expense(s) or<br />

liability(ies) of every kind arising from or relating to any and all claim(s), lien(s),<br />

demand(s), obligation(s), action(s), proceedings or causes of action of any kind in<br />

connection with, or arising directly or indirectly from, negligent error(s) and/or<br />

omission(s) and/or act(s) by the person (including the entity or ground transportation<br />

services provider's employees, agents and/or contractors) in the performance of this<br />

agreement.<br />

B. Without limiting the generality of the foregoing, any and all such claims, etc., relating to<br />

personal injury, death, damage to property or any actual or alleged violation of any<br />

applicable statute (including specifically but not limited to New York State Labor Law<br />

§§ 240 and 241), ordinance, administrative order, executive order, rule or regulation or<br />
