TEPEE INCINERATOR — Fire enclosed in a truncated cone, with or without fire grates.<br />

TRADE WASTE — Combustible solid or liquid material resulting from construction or any<br />

business, trade or industry operations, including but not limited to the following materials:<br />

plastics, cartons, chemicals, paints, greases, oils, other petroleum products, sawdust, dead<br />

animals and dead fowl.<br />

§ 168-21. Commissioner's powers and duties concerning air pollution.<br />

The Commissioner shall have the following powers and duties:<br />

A. To control and abate air pollution in accordance with any code, rule or regulation which<br />

the <strong>Broome</strong> <strong>County</strong> Legislature may promulgate under this article and the New York<br />

State air pollution control rules and regulations.<br />

B. To investigate complaints, make observations of smoke and other air pollution conditions<br />

and air pollution nuisances and require the necessary and proper steps to comply with<br />

this article.<br />

C. To inspect from time to time any installation, equipment or devices that may, can or do<br />

cause air pollution or air pollution nuisance.<br />

D. To enforce the provisions of this code.<br />

E. To disseminate information to the public on air pollution reduction and control.<br />

F. To enlist the cooperation of civic, trade, technical, scientific, educational, governmental<br />

and other organizations in the control and reduction of air pollution.<br />

§ 168-22. Prohibitions.<br />

A. General.<br />

(1) No person shall undertake to construct a new installation which will or might<br />

reasonably be expected to increase the amount or change the effects or the<br />

characteristics of the air contaminants discharged or install an air-cleaning device<br />

without first submitting plans and specifications to the Commissioner for approval<br />

and without obtaining such approval prior to the initiation of construction. These<br />

plans and specifications will be reviewed and/or approved in accordance with the<br />

Rules to Prevent New Air Pollution, adopted by the New York State Air Pollution<br />

Control Board as authorized by the Public Health Law.<br />

(2) In the event that the requirement for approval prior to construction will create an<br />

undue hardship to the applicant, the applicant may request of the Commissioner a<br />

waiver to proceed with construction. The application for a waiver shall explain the<br />

circumstances which will cause undue hardship.<br />

(3) If a waiver is granted, the applicant shall submit a report and/or plans and<br />

specifications for approval as soon as is reasonably practical, as specified by the<br />

Commissioner. The applicant, after a waiver is granted, proceeds with the<br />
