§ 106-3 BROOME COUNTY CHA<strong>RT</strong>ER AND CODE<br />

COUNTY EXECUTIVE — The <strong>County</strong> Executive of the <strong>County</strong> of <strong>Broome</strong>, and/or his duly<br />

authorized personnel.<br />

LEGISLATURE — The <strong>County</strong> Legislature of the <strong>County</strong> of <strong>Broome</strong>.<br />

NORMAL HOURS OF OPERATION — The period of time when such buildings and<br />

grounds are open to the general public.<br />

PERSON — Includes persons, corporations and other groups.<br />

SHERIFF — The Sheriff of the <strong>County</strong> of <strong>Broome</strong> and/or his duly authorized personnel.<br />

§ 106-4. Conduct upon buildings and grounds; permits; prohibitions.<br />

A. Public assembly on buildings and grounds.<br />

(1) No person, group or organization gathering, collecting or congregating for common<br />

purpose or objective, and whether designated as a parade, procession, vigil,<br />

assembly, demonstration or like terms, shall assemble upon said <strong>County</strong> grounds<br />

unless a written permit is received from the <strong>County</strong> Executive or his duly<br />

authorized representative.<br />

(2) The application for said permit shall be verified by petition, addressed to the<br />

<strong>County</strong> Executive and filed with the <strong>County</strong> Executive or his duly authorized<br />

representative at least 24 hours prior to the date upon which said assembly is<br />

contemplated.<br />

B. Standards for issuing permits. The <strong>County</strong> Executive, or his duly authorized<br />

representative, in granting or rejecting a permit, will be governed by the following<br />

criteria:<br />

(1) The rights of all citizens under the Federal and State Constitutions to peaceably<br />

and lawfully assemble for expression of views or opinions.<br />

(2) The requirement as to the date and time so that the proper operation of <strong>County</strong><br />

government of the appropriate state or <strong>County</strong> courts will not be interfered with.<br />

Preference will be given to assemblies held at hours when the normal work force<br />

of <strong>County</strong> government is not present.<br />

(3) The requirement that the group or organization requesting a permit is not for<br />

illegal purposes as set forth by appropriate federal, state and local laws.<br />

(4) That said organization or group has not previously engaged in acts of vandalism or<br />

destruction of property, nor has it violated appropriate federal, state and local laws<br />

during previous parades, demonstrations or assemblies.<br />

(5) That said principal members of said organization or group, during previous use of<br />

<strong>County</strong> property, whether in the petitioning group or organization or another group<br />

or organization, have adhered to the requirements of this chapter.<br />

C. Preservation of property. No person shall injure, deface, destroy, disturb, remove or<br />

misuse any part of the grounds or any buildings, sign, equipment or other property.<br />
