E. Adult residential facilities consisting of 20 or more residential dwelling units, during<br />

hours of operation.<br />

§ 168-47. Facilities/Organizations required to have AED available. [Amended 7-17-2008<br />

by L.L. No. 4-2008]<br />

The following facilities/organizations are required to have an AED available on-site:<br />

A. All municipal recreation fields or facilities, during events at which 500 or more<br />

individuals are in attendance at any given moment in time, including participants,<br />

officials, and spectators.<br />

B. Golf courses are required to have an AED on site and an employee trained in CPR and<br />

AED's. Golf courses are required to post, in the clubhouse and all golf carts, signs that<br />

state that an AED is available and the location of the AED. Said signs shall include the<br />

phone number for the golf course pro shop or business office or building where the AED<br />

is located as well as the phone number for the appropriate emergency medical<br />

responder(s).<br />

§ 168-48. Investigations; enforcement; penalties for offenses.<br />

Article VII of this chapter shall apply to investigations, enforcement and penalties.<br />

§ 168-49. Waivers.<br />

Those entities subject to the requirements of this article that do not have an AED on site and a<br />

person trained in CPR and the use of an AED available on the effective date of this article<br />

shall have six months from the effective date of this article to comply with said requirements.<br />

Prior to the expiration of said six-month period, the <strong>Broome</strong> <strong>County</strong> Commissioner/Director<br />

of Health, upon application of the entity, may waive compliance with this article for an<br />

additional period of six months.<br />

§ 168-50. Limitation of liability.<br />

Section 225(5-b)(e) of the New York Public Health Law shall apply to any public access<br />

defibrillation provider or any employee or other agent of the provider who, in accordance with<br />

the provisions of the Public Health Law and this article, voluntarily and without expectation<br />

of monetary compensation renders emergency medical or first aid treatment using an AED<br />

which has been made available pursuant to the requirements of this article or the New York<br />

Public Health Law.<br />

§ 168-51. Interagency cooperation.<br />

All schools are encouraged to make their AEDs available to community groups when<br />

nonsponsored events take place at their facilities. Troop C of the New York State Police,<br />

when responding to incidents in <strong>Broome</strong> <strong>County</strong>, is requested to provide an AED and trooper<br />

trained in its use. All places of worship are encouraged to have an AED and trained operator<br />
